BACKGROUND & DISCUSSION
The site of the proposed public storage and vehicle (truck and trailer)
rental business is the now vacant Lyon's Moving & Storage facility on
Laguna Road, approximately 160 feet west of Redhill Avenue. The services
to be provided include the rental of U-Haul trucks and trailers, rental and
sale of related items, hitch installations, minor repair and maintenance of
trucks and trailers, dispensing of petroleum products, the outside storage
of trucks and trailers and the temporary storage and warehousing of
customers's goods.
The storage of the vehicles is to be in the rear of the site which is
currently surrounded by a chain link fence. Proposed customer and employee
parking is along the eastern property line and in the front setback area.
The site does not now conform to development standards, but the addition of
planters along the front setback and eastern property line is indicated on
the plans.
Also included in the proposal is the addition of a pump island for gasoline
dispensing.
The City staff reviewed the application with recommendations for the
project included in the accompanying draft resolution.
Findings & Conclusions
1. The proposed activity is similar in nature to the previous use
as a moving and storage facility.
2. Outdoor sales and storage is authorized in the C-2 District
subject to a use permit approval.

The addition of planters will reduce the property's degree of
non-conformity.
The proposed signing does not conform to sign code. Maximum
authorized signing is as follows:
1 - 64 sq.ft, front wall sign
i - 25 sq.ft, sidewalk sign
1 - 32 sq.ft, double face monumental sign or pole sign (by
permit)
A request for the continued use of the non-conforming roof
sign has been applied for in Variance Application No. 82-3.
Parking space number five extends into the driveway area and
should not be allowed. This space should be relocated .
Staff's recommendation for approval is based upon the
following conclusions:
a. The proposed storage use is similar to the previous
activity and therefore should not negatively impact the area.
b. The vehicle rental use is provided with an adequate storage
area and it should not present a negative visual impact if
properly screened from view.
c. All signing should be in conformance with code provisions.
d. Site improvements will enhance the appearance of the
development and the vacant development will be productive once
again.

A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, APPROVING USE PERMIT NO. 82-4
AUTHORIZING THE RENTAL AND STORAGE OF TRUCKS
AND TRAILERS IN CONJUNCTION WITH A PUBLIC
STORAGE BUILDING AT 1431 LAGUNA ROAD
The Planning Agency of the City of Tustin does hereby resolve as
follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application, (Use Permit No. 82-4), has
been filed by U-Haul Company of Orange County to
authorize the operation of a vehicle rental facility in
conjunction with a public storage building at 1431
Laguna Road.
B. That a public hearing was duly called, noticed and
held on said application.
C. That establishment, maintenance, and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals,
comfort, or general welfare of the persons residing or
working in the neighborhood of such proposed use,
evidenced by the following findings:
1. The vehicle rental activity is in conformance with
the provisions of the C-2 District.
2. The use is similar in nature to surrounding vehicle
service businesses.
D. That the establishment, maintenance, and operation
of the use applied for will not be injurious or detri-
mental to the property and improvements in the neighbor-
hood of the subject property, nor to the general welfare
of the City of Tustin, and should be granted.
E. Proposed development shall be in accordance with the
development policies adopted by the City Council, Uni-
form Building Codes as administered by the Building
Official, Fire Code as administered by the Orange County
Fire Marshal and street improvement requirements as
administered by the City Engineer.
F. Proposed development is exempt from the reporting
requirements of the California Environmental Quality
Act.
G. Final development plans shall require the review and
approval of the Community Development Department.

II. The Planning Agency hereby approves Conditional Use
Permit No. 82-4 to authorize the trailer and truck rental
activity as applied for subject to the following conditions:
The final site plan shall be standardized and reflect
all appropriate City standard drawing numbers. The
developer shall construct all missing or damaged street
improvements to said development per the City of Tustin
"Minimum Design Standards of Public Works" and "Street
Improvement Standards". This work shall consist of,
but is not limited to: curbs and gutters, sidewalks,
drive apron, and street pavement and street trees.
The subject parcel will require annexation to the Orange
County Street Lighting and Maintenance District No. 6.
Proof of submission application papers should be
provided the City prior to the issuance of any building
permit/occupancy permit.
C. Installation of marbelite street lights with underground
conduit as required by the City Engineer's office.
D. Payment of Orange County Sanitation District fees will
be required prior to issuance of a building permit.
Construction plans shall be submitted for review and
approval by the City Plan Checker. The plans shall
conform to all applicable provisions of the Uniform
Building Code, 1979 edition and shall include but shall
not be limited to the following:
1. The building shall be accessible to the handicapped
by providing the necessary ramps and plumbing facilities
conforming to Sections 3306 and 1711 of Uniform Building
Code.
2. The exits of the building shall comply with Chapter
33 of the Uniform Building Code.
3. The hitch and maintenance room which is a B-1
occupancy shall have an occupancy separation of at least
1-Hr. fire-resistive construction as required by Table
5-B of Uniform Building Code.

Signing shall conform to all applicable provisions of
Sign Code Ordinance No. 684.

The trailer and vehicle storage area shall be screened
with an attractive view-obscuring fence.
Planting and irrigation plans shall be submitted for
review prior to the commencement of landscape work.
The parking area shall be modified to conform to the
City's development standards by relocating visitor
parking space number five.
No outside display or storage of vehicles is authorized
in the front and side yard areas except by temporary use
permit.
K. Fire hydrants shall be provided as determined by the
Orange County Fire Marshall's Office.
L. Fire sprinklers shall be provided as required in
N.F.P.A. Standard 13.
