HomeMy WebLinkAboutCC MINUTES 1956 04 09226 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF TUSTIN, CALIFORNIA, HELD ON MONDAY EVENING, APRIL 9, 1956, IN THE CITY HALL COUNCILMEN PRESENT: Kidd, PArk, Bacon, Tadlock and Byrd. COUNCILMENABSENT: None CITY ATTORNEY: C. Arthur Nisson, Jr., was present. Mayor Kidd called the meeting to order at 7:35 P. M. Upon motion of Park, seconded by Bacon and carried, minutes of the previous meeting were approved as mailed out. Mayor Kidd announced that the Council now sat to hear protests, if any, regarding the proposed "Pankey An- nexation" to the City of Tustin. No protests, written or otherwise, were received. City Clerk reported that notice of this hearing was duly published and mailed to all persons entitled to receive same. Park moved, seconded by Tadlock and it was duly carried that the hearing be closed. A communication from City Engineer McBride was pre- sented in which he estimated the value of land and im- provements owned by the State of California within the Pankey Annexation to be as follows; right of way 16 acres at $2,000 per acre $32,000; improvements $300,000. Excess parcel of 1.3 acres adjacent to Tract No. 1863, $1,000 for land and $300 for trees. Upon motion of Tadlock, seconded by Park and carried, it was ordered that this communication from Engineer McBride be received and filed and the valuations of State owned property is approved as set forth in his letter. Ordinance No. 99 entitled "An Ordinance of the City of Tustin, California, Accepting and Approving Pankey's Annexation to Tustin" was presented and read by title only upon motion of Bacon, seconded by Park and duly carried. First reading of Ordinance No. 99 was approved upon motion of Tadlock, seconded by Bacon and carried. City Attorney Nisson stated that the total price set by the State on the Hellis property triangle, compris- ing approximately three (3) acres on West Sixth Street is $15,435. Upon motion of Tadlock, seconded by Park and duly carried, Attorney Nisson is authorized to request the proper papers from the State in this matter. Mayor Kidd announced that the Council now sat as a hearing body in regard to the proposed Griset Annexa- tion. There were no written or verbal protests re- ceived regarding this Annexation. The City Clerk re- ported that notice of this hearing was duly published and mailed to all persons entitled to receive notice. Lucius E. Allen and Richard Featherstone were present and inquired as to the possible rezoning of this annexa- tion. A letter from Engineer McBride containing an estimate of the value of land and improvements owned by the State of California within the Griset Annexation was estimated to be as follows: right of way, 15 acres at $2,000 per acre. Improvements on right of way, $300,000. A parcel owned by the State, land $5,000; trees, $500. Upon mo- tion of Park, seconded by Byrd and carried, Mr. McBride's letter was ordered received and filed and the estimated valuations of State property and improvements be approved. Ordinance No. 100 entitled "An Ordinance of the City of Tustin, California, Accepting and Approving Griset's An- nexation to the City of Tustin" was presented and read by title only upon motion of Tadlock, seconded by Byrd and duly carried. Upon motion by Bacon, seconded by Tadlock and carried by roll call vote, first reading of Ordinance No. 100 was approved. Mayor Kidd declared the Griset Annexation Hearing closed. City Attorney Nisson read a petition read a petition re- questing annexation of three (3) lots at the South East Corner of First and Prospect Streets proposed to be desig- nated "Claus Annexation" to the City of Tustin. Mr. McBride reported the hazardous condition of a pepper tree in front of 530 South "B" Street. He was requested to obtain a price on whatever action he may deem necessary and report back to the Council. RESOLUTION NO. Resolution No. 385 entitled "A Resolution of Intention 385 ADOPTED to Annex Territory Pursuant to Annexation of Uninhabited Territory Act of 1939, Describing the Property to be An- nexed, Describing the name of the Annexation and Setting the Time and Place for Hearing Protests Thereto" was pre- sented and adopted upon motion of Park, seconded by Bacon and carried by roll call vote. RESOLUTION NO. Resolution No. 384 entitled "A Resolution of the City 384 ADOPTED Council of the City of Tustin Finding that the Improve- ment to South "B" Street from the center line of Sixth Street to the Intersection of "B" Street and Frontage Road Adjacent to the Santa Ana Freeway has been com- pleted, Approving the Report of the City Engineer and Requesting Payment from the County of Orange of a Por- tion of California Highway Users Tax Fund to the City of Tustin" was presented and adopted upon motion of Park, seconded by Tadlock and carried by roll call vote. Councilman Park read a report from Engineer McBride on the above. Bills were presented, approved and ordered paid upon motion of Park, seconded by Byrd and carried.
