HomeMy WebLinkAboutOB 1 SIGN ORD 684 03-15-82OLD BUSINESS NO. 1 1 2 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 RESOLUTION NO. 2024 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, GRANTING AUTHORIZATION TO VARY WITH REQUIREMENTS OF TUSTIN SIGN ORDINANCE 684 PERTAINING TO ROOF SIGNS The Planning Agency of the City of Tustin d~es hereby resolve as follows: I. The Planning Agency finds and determines as follows: A. That a proper application,(Variance No. 82-3), was filed by U-Haul of Orange County requesting authoriza- tion to vary with the requirements of Tustin Sign Drdinance 684 to allow a 150 square foot roof sign on building located at 1431 Laguna Road. B. That a public hearing was duly called, noticed and held on said application. C. That because of special ciroumstances applicable to the subject property, relative to size, shape, topo- graphy, location or surroundings, a strict application of the Zoning Ordinance is found to deprive subject property of privileges enjoyed by other properties in the vicinity and under-identical zone classification, evidenced by the followi6g findings: 1. The use is in conformance with the land use element of the Tustin Area General Plan. 2. That the rental and storage use qualifies for freeway identification. 3. That the variance as granted authorizes a sign that reduces the non-conformity of an existing sign and therefore is consistent with the intent of Article VI, Section 2 of Ordinance 684. D. That the granting of a variance as herein provided will not constitute a grant of special privilege in- consistent with the limitations upon other properties in the vicinity and district in which the subject property is situated. E. That the granting of the variance as herein provided will not be contrary to the intent of the Sign Ordinance or the public safety, health and welfare, and said variance should be granted. G. Proposed development shall be in accordance with the development policies adopted by the City Council; Uni- form Building Codes as administered by the Building Official; Fire Codes as administered by the Orange County Fire Marshal; and street improvement require- ments as administered by the City Engineer. H. Final development plans shall require the review and approval of the Community Development Director. II. Planning Agency hereby grants a variance as applied for, to authorize a 150 square foot roof sign, subject to the following conditions: A. Three sets of plans shall be submitted to the Community Development Department for building plan check. Inlcuded with these plans shall be a structural analysis of the roof of the structure being served as well as a complete structural analysis of the proposed sign. B. Final location, copy and colors of the roof sign shall be submitted for review and approval of the Community Development Department Di rec tot. C. All necessary building and electrical permits will be obtained prior to the erection of any signs on the property, including any wall signs. D. That the approval of Variance 82-3 only permits a variation to height, location and size of the sign, all other provisions of the Sign Code must be met. Further, all other signs associated with the U-Haul operation shall conform to all provisions of Ordinance 684. E. That the subject roof sign is approved for a rental and storage use only.
