Draft Ordinance For Game Arcades
The City Attorney's office has submitted for staff review, a preliminary
draft ordinance for the regulation of game arcades. The ordinance would
add site and operation requirements for arcades to the code provisions of
pool halls and bowling alleys (Article 3, Chapter 3). The zoning
regulations would also be amended to authorize arcades, pursuant to Article
3, Chapter 3, in certain commercial districts subject to Planning Agency
approval.
Planning staff has reviewed the document and for the Council's considera-
tion would offer the attached analysis of alternative provisions. These
alternatives are for discussion purposes at this time.
Staff believes that definitions should be expanded to clarify the intent of
the regulations as follows:
shopping center - A group of three or more retail stores, plus any
related service facilities utilizing common facilities including off-
street parking, access and landscaping. It does not have to be under
single ownership;.however, the site shall be in excess of 2 acres.
distance - Measured from game arcade front door to property of
alternate activity (residential, parks, etc.) by an unobstructed
direct line.
c. school - Public and private, grades K-12.
It is recognized that any ordinance will need additional fine-tuning on a
case-by-case basis and that these recommendations will not necessarily be
the limit of possible conditions of operation since the use permit process
will still leave the review open to individual site analysis.
