BACKGROUND & DISCUSSION
On October 27, 1969, the Planning Commission approved a center
identification pylon sign for the Stater Brothers Shopping Center (Use
Permit 6g-312). The approval for the sign was 675 square feet per side
which included ten (10) panels of two feet by twelve feet (2' x 12').
(Please see Exhibit "A").
To date, the existing sign consists of 340 square feet and only seven (7)
of the ten (10) panels have been installed. The applicant is requesting to
install one of these remaining panels (see Exhibit "B").
The applicant was instructed to obtain a variance because the sign code
requirements for a center sign have changed since 1969.

THE CITY OF TUSTIN, GRANTING AUTHORIZATION
TO VARY WITH REQUIREMENTS OF TUSTIN SIGN
ORDINANCE 684 PERTAINING TO SHOPPING CENTER
IDENTIFICATION SIGNS

The Planning Agency of the City of Tustin does hereby resolve as
follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application,(Variance No. 82-5), was
filed on behalf of Lincoln Savings requesting authoriza-
tion to vary with the requirements of Tustin Sign
Ordinance 684 to allow a 21 square foot panel on an
existing center identification sign at 14161Redhill
Avenue.

B. That a public hearing was duly called, noticed and
held on said application.
C. That because of special circumstances applicable to
the subject property, relative to size, shape, topo-
graphy, location or surroundings, a strict application
of the Zoning Ordinance is found to deprive subject
property of privileges enjoyed by other properties
in the vicinity and under identical zone classification,
evidenced by the following findings:
1. The use is in conformance with the land use
element of the Tustin Area General Plan.

2. The proposed sign panel does not grant a special
priviledge because other businesses in the center
have panels of equal square footage on the existing
center sign.
3. That a Use Permit (69-312) was previously
approved that allowed 675 square feet of signing of
which only 340 square feet has been installed.
D. That the granting of a variance as herein provided
will not constitute a grant of special privilege in-
consistent with the limitations upon other properties
in the vicinity and district in which the subject
property is situated.
E. That this project is categorically exempt from the
requirements of the California Environmental Quality
Act.

F. That the granting of the variance as herein provided
will not be contrary to the intent of the Sign
Ordinance or the public safety, health and welfare,
and said variance should be granted.
G. Proposed development shall be in accordance with the
development policies adopted by the City Council; Uni-
form Building Codes as administered by the Building
Official; Fire Codes as administered by the Orange
County Fire Marshal; and street improvement require-
ments as administered by the City Engineer.
H. Final development plans shall require the review
and approval of the Community Development Director.
II. Planning Agency hereby grants a variance as applied
for, to authorize a 21 square foot panel on an existing
center identification sign, subject to the following
conditions:
A. Sign plans shall be submitted for review and
approval prior to permit issuance.
B. The sign colors shall match the existing center
master sign plan.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Agency, held on the day of , 1982.
