Staff recommends Use Permit 81-5 be extended from April 6, 1982 to April 6,
1983. This extension may be granted by Minute Order.

If the Planning Agency extends Use Permit 81-5, Staff recon~nends that
Tentative Tract Map 11389 be extended from April 6, 1982 to April 6, 1983.

BACKGROUND & DISCUSSION
On April 6, 1981, the Planning Agency approved Use Permit 81-5 authorizing
the conversion of leaseable office units into office condominiums. The
Tentative Tract Map, in conjunction with the subject Use Permit, was also
approved on April 6, 1981. The applicant still wishes to proceed with the
conversion, however, will be unable to do so prior to the expiration date
of April 6, 1982.
Generally, a Use Permit remains in effect indefinitely as long as steps
have been taken to implement the project. Since the complex was built
at the time of conversion approval, the only way to implement the Use
Permit is to file a Final Tract Map. Almost all of the conditions of
approval for the Use Permit have been fulfilled by the applicant. The
exceptions being those pertaining to the subdivision (i.e., the C.C.&R's
and Final Tract Map need to be filed).
Staff considers the fulfillment of the remaining conditions as formalities
and cannot foresee any problems in permitting the extensions as requested.
It is therefore recommended that the extension of Use Permit 81-5 and
Tentative Tract Map 11389 be granted for a period of one year.
