CLAIM FOR DAMAGES TO: City Council City of Tustin 300 Centennial Way Tustin, California This Claim is presented by Frank P. Barbaro, of Horton Barbaro & Reilly, Attorneys at Law, on behalf of GEORGE F GUTHRIE. The post office address of claimant is all notices respecting this Claim should be sent to Horton Barbaro & Reilly, 1020 North Broadway, 4th Floor, Santa Aha, California 92701. The dates and places giving rise to'this Claim are: October 18, 1981, at 15652 Williams, Tustin, California, and Tustin Police Department, 300 Centennial Way, Tustin, California. The circumstances giving rise to this Claim are as follows: On the aforesaid date at approximately 2:00 A.M, respondent officers, identified as Officer Linda Andrews, Officer D. Kreyling, Officer Van Gorder and Sergeant George, 1 5 6 7 8 9 .10 11 12 13 14 15 16 17 18 19 2O 21 22 24 25 26 27 28 without legal cause, justification or consent, unlawfully arrested and detained claimant against his will and did unlawfully and without legal cause, justification or consent assault and batter claimant, causing claimant to suffer severe bodily injuries and emotional distress. The identity of any other involved officers is unknown. Claimant is informed and believes that the conduct of said officers was counselled, ratified and approved by the CITY OF TUSTIN and the Tustin Police Department. Claimant seeks recovery on the basis of (1) false arrest, (2) false imprisonment, (3) assault and battery, (4) violation of civil rights, (5) intentional infliction of emotional distress, (6) negligent infliction of emotional distress, (7) negligence and (8) negligent hiring and supervision. The full extent of claimant's injuries and damages is unknown at this time and remains indefinite, though is believed to be in excess of $75,000.00.
