It is recommended that the Agency approve Temporary Use Permit No. 59106 by
Minute Order.
BACKGROUND
Article VIII, Section 2D of Tustin Sign Ordinance 684 provides that upon
receipt of a temporary use permit banner signs may be displayed for "30
days duration per quarter." The permit may be issued by the Community
Development Department. Additionally, Section 927C of the zoning code
states that the Planning Agency may grant temporary use permits for up to
six months at a time.
DISCUSSION
An application has been filed on behalf of the Congregation B'Nai Israel
requesting that they be permitted to display a banner sign on the trellis
of their suite advertising a weekly bingo game. Specifically, the request
is to display a "Bingo Tuesday" banner every Tuesday for a period of six
months. Staff would anticipate that at the end of that time frame, the
Congregation will request a subsequent six month permit.
As was pointed out in the background section of this report, a banner as
requested would be allowed and a permit would usually be issued without
question by the Community Development Department. However, because of the
fact that the request surpasses the 30-day duration restriction, the Agency
must make the decision to approve or deny the subject request.

is felt however, that a precedent should not be set that would en¢oura§e
applicants to request a "renewal" of temporary use permits every six
months. The consequences of such a precendent would be to turn banner
signs into permanent rather than temporary advertisement. Hopefully, at
the end of six months, the Congregation's bingo operation will be
successful enough to draw the desired number of participants on its own,
and the need for a banner for such a prolonged period of time will no
longer be necessary.

Packer's Square, A Partnership, is aware that the above named tenant
has requested permission to hang a banner on top of the trellis
immediately above their leased premises.
The Robert P. Warmington Co., property manager for Packer's Square,
A Partnership, has no objection to the permit and use for this banner.
