Staff recommends that Use Permit 80-21 be extended to June 1, 1982. The
extension may be granted by minute order.
RECOI~NENDED ACTION-CITY COUNCIL
Staff recommends that Tentative Tract Map 11336 be extended to June 1,
1982. The extension may be granted by minute order.
Both of these recommendations are based on the stipulation that the owner
of the project be made aware that no further extensions will be granted for
the Use Permit, and that pursuant to the State Subdivision Map Act no
further extensions of the Tentative Map are permissible.
BACKGROUND
In November, 1980, the Planning Agency approved Use Permit 80-21, thereby
authorizing the conversion of the Windsor Gardens Apartments into
residential condominiums. Tentative Tract Map 11336 was subsequently
approved by the Council on December 1, 1980.
On October 21, 1981, both the Use Permit and the Tract Map were extended
for six months in actions taken by the Agency and the Council. As it
stands now, the Use Permit will expire on May 17, 1982 and the Map will
expire on June 1, 1982.
At the May 3, 1982 meeting, the Agency requested that the developer be
present today to answer any questions and to reassure the Agency that the
project is essentially the same as when originally approved. It is staff'
understanding that a representative of Cai-State Associates will be in
attendance.

The applicant, on behalf of Cal State Associates, has requested that
Tentative Tract Map 11336 be extended for an additional one year. If the
Tract Map is extended, Use Permit 80-21 must also received an extension.
The applicant has stated that all conditions of the tentative map have
either been met, or are in the process of completion. Delays in obtaining
new preliminary subdivision reports from the Department of Real Estate (due
to a change in ownership), and the fact that the map is in need of some
alterations so as to accommodate the renovation of the domestic water
systems have been the major obstacles standing in the way of submission of
the Final Tract Map.
Should the Council extend the Tentative Tract map for one year as
requested, it would be the final extension allowable pursuant to applicable
City Codes and the State Subdivision Map Act.
Staff cannot foresee any adverse impacts resulting from the additional time
allottment and thereby recommends the extension be granted. However, it
must be stressed that Tentative Tract Map 11336 will expire, and may not be
further extended as of June 1, 1983. If the Final Map is not approved by
'that date, a new tentative map must be submitted for review approval. The
process would include renotificaion of all tenants, a re-submittal of a
tenant relocation plan, and a re-application for a Conditional Use Permit.

RE: THE CALIFORNIAN & WINDSOR GARDEN CONDOMINIUM CONVERSIONS
Dear Mayor Edgar:
The following is a status report on the above referenced
projects as requested in the last council meeting of
May 3, 1982.
WINDSOR GARDENS
Windsor Gardens was originally owned by Cal State Associates
and sold to a group represented by Mr. Fred King. This group
applied for and obtained approvals for a condo conversion and
tentative tract map. Because of inadequate financing, this
project has been joint ventured with Cal State Associates
becoming the general partner.
The exterior o£ the project has not been altered. The only
changes are as follows:
1. A fire truck turn-around at the rear of the garages which
was incorporated to satisfy the fire marshall.
2. The tennis court has been moved away from the rear property
line to avoid any light spillage on the adjoining property.
3. The trash bins have been relocated from the front yard to
another less visable area.
Plans have been received out of plan check and final corrections
are now being made. During the past week we had a combined
coordinating meeting with the fire marshall, city engineer and
water department. The result of this meeting was a minor
modification which has been made to the water service which has
now satisfied all agencies concerned. These changes are being
incorporated on the final tract map and working drawings and
will be back to the city next week.
Bonds have been prepared and will be submitted to the city with
the final map in the near future. At that time we will notify

the tenants of the final tract map hearing as prescribed by
law.
The C.C.&R's have been reviewed and approved by the city.
We are currently submitting a tenant relocation plan similar
to the Californian plan. We have applied for an extension
of time on the tentative tract map.
THE CALIFORNIAN
Since the city council approval in January, we have coordinated
with the city staff the requirements of the conversion. Where
drawings of existing facilities have been unclear~ survey crews
of architects, engineers and contractors have been reviewed the
project and prepared p~ans for Cal State Associates. These
plans have been submitted to the city and are currently in plan
check.
The tentative tract map has been submitted; all legal notices
pertaining to it have been sent and affidavits to that effect
have been submitted to the city for verification.
Upon approval, the ten (10) day notices will be sent out. In
addition~ the rough draft of the C.C.&R's has been submitted
to the city for review. We have met with the fire marshall,
city engineer and water department and incorporated their
requirements in our drawings.
One of the residents, Steve Price, has been appointed as tenant/
developer coordinator and a detailed relocation plan has been
submitted and approved by council.
Should you require any additional information, we will be
available for discussion at your next city council/planning
meeting scheduled for Monday, May 17, 1982.
