Use Permit 80-10, Tustin Arms II
RECOI~liOEO ACTION
Staff recommends that the Planning Agency withdraw Use Permit 80-10 which
was approved by Resolution No. 1899, with a new request requiring a new Use
Permit application and procedure.
REQUEST - The owners of Tustin Arms II apartment complex have requested
that their Use Permit approval for condominium conversion
(Resolution No. 1899) be withdrawn by the Planning Agency. They
will be maintained as an apartment complex for the foreseeable
future.
DISCUSSION
Under the advice of the City Attorney, neither a formal application or
public hearing are required to withdraw an approved Use Permit. In
addition, no formal action is required. The tenants of the complex can be
contacted prior to the withdrawal of the Use Permit if the Agency feels it
is necessary, but it should be noted that there are no grounds to deny the
request to have the Use Permit withdrawn.
After the Use Permit is voided, the complex will revert to an apartment
status. Those tenants who have lived at the complex since the approval
will have their rents unfrozen and will not be eligle for tenant relocation
assistance. There will be no change for tenants who moved into the complex
after the Use Permit approval.
Since the Use Permit will be formally withdrawn, the owners of the complex
will be required to file an entirely new Use Permit if they choose to
convert again. There will not be any credit for monies paid to tenants for
relocation assistance under the old Use Permit

The owners of Tustin Arms II located at 15851 Pasadena Avenue
in the City of Tustin hereby request that approval for condo conversion
be withdrawn by the City of Tustin.
The owners desire to continue to operate the property as an
apartment project for the foreseeable future.
