SUBJECT: LETTER OF AGREEMENT RE: COLUMBUS TUSTIN PARK SHADE SHELTER
RECO~MENDATION
That the City Council authorize the City Manager to execute a letter of agreement
with the Tustin Unified School District establishing clearly that the City of
Tustin will retain ownership of the park shade shelter structure and will be
fully liable and responsible for any damage, loss, or maintenance expenses for
the shade shelter structure.
BACKGROUND
Part of the approved and budgeted capital improvements program for fiscal year
81/82 is the installation of a shade shelter for picnic use on Columbus Tustin
Park, near the concession area and tennis courts. The shelter and other
improvements are proceeding on schedule. The shade shelter is on school
property, and our agreement with the School District calls for the School
District to retain ownership of any structures erected on school property. Since
the City is funding the shelter, it does not seem prudent for the School District
to retain ownership; therefore, after discussing the matter with School District
staff, we have concluded that a separate letter amending the agreement will make
it clear that the City will retain ownership of the shade shelter structure even
though it is on a portion of the park which is school property. The City will
also be fully responsible for any liaibility, as well as for maintenance of the
structure and other improvements which are part of this development.
This action will simply allow the City to retain ownership of the park shade
shelter structure.
