Recommend to the City Council approval of Tentative Tract 10300 by the
adoption of Resolution No. 2035.
BACKGROUND & DISCUSSION
Subject tentative map consists of six (6) numbered and two (2) lettered
lots. The numbered lots are divided in this manner for sales purposes.
On January 18, 1982, the Planning Agency approved the conversion of the
California Apartments to condominiums (Variance 81-8).
The map is in conformance with the Tustin Area General Plan. The zoning on
the property is R-3 and the project will conform to the standards of the
Planned Development District. In order to comply with the open space
requirements, 25,000 square feet of existing apartments will be removed.
The conditions of approval are listed in Resolution 2035.

RESOLUTION NO. 2035
A RESOLUTION OF THE PLANNING AGENCY OF
THE CITY OF TUSTIN RECOMMENDING APPROVAL
OF TENTATIVE TRACT MAP NO. 10300
The Planning Agency of the City of Tustin does hereby resolve as
follows:
I. The Planning Agency finds and determines as follows:
A. That Tentative Tract 10300 was submitted to the
Planning Agency by Mollenhauer, Higashi & Moore, Inc. on
behalf of Cai-State Associates pursuant to Ordinance
No. 847 for the purpose of creating six (6) numbered and
two (2) lettered lots for residential condominium
purposes for the property described as a portion of Lot
64, Block 11, Irvine Subdivision, Book 1, Page 8, m.m.,
Records of Orange County.
B. That said map is in conformance with the Tustin Area
General Plan.
C. That the project is categorically exempt from the
requirements of the California Environmental Quality
Act.
II.
The Planning Agency hereby recommends approval of
Tentative Tract Map No. 10300, subject to the following
conditions:
A. That covenants, conditions and restrictions shall be
submtted for review and approval by the City Attorney
which shall contain:
1. The formation of a "Community Assocation" to
provide for the maintenance of the con,non area.
2. Disclosure of management agreements, maintenance
provisions, access for emergency repairs, easements,
etc., so future purchasers will be aware of some
problems which might occur.
3. Disclosure of the possibility that Newport Avenue
might be extended southerly to Edinger Avenue
resulting in additional traffic on Newport Avenue.
4. Reciprocal access easements will be required
between each of the lots for parking, utilities
and/or circulation.
B. The final site plan shall be standardized and reflect
all appropriate City standard drawing numbers. The
developer shall construct all missing or damaged street

improvements to said development per the City of Tustin
"Minimum Design Standards of Public Works" And "Street
Improvement Standards." This work shall consist of but
is not limited to:
a. curbs and gutters
b. sidewalks
c. drive aprons
d. street pavement
e. street trees
f. street lights
C. The drive access to Carfax Drive is to be used soley
for emergency purposes and a method of securing the
drive must be indicated.
D. That a perpetual easement shall be provided for all
utilities (sewer, water, telephone, gas, electricity,
heating, air conditioning, etc.)
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Agency held on the~day of , 1982.
