It is recommended that the City Council, at their meeting of June 7, 1982, by
Minute Order, reject all bids for subject project which were received on May 10,
1982.
It is further recommended that the City Council pass and adopt the attached
resolution approving revised plans and specifications for subject project and
directing the City Clerk to advertise for bids.
BACKGROUND:
Sealed bids for subject project were opened on May 10, 1982 and were received as
follows:

The Engineer's estimate for this project is $1,004,616.90.
The bids were analyzed by CalTrans and the City and subsequent discussions and
meetings with the low bidder and signal equipment manufacturers revealed that all
of the bidders, except the 3rd low bidder (Mc Cain Construction Co. Inc.)
apparently based their bids on signal controller equipment which does not meet the
specifications as written. The apparent difference in cost between the equipment
which meets the written specifications and that which does not is $72,000.00.
Consequently, it is conceivable that if Mc Cain had based their bid on the same
equipment as the other bidders, they would have been able to su~m~it a bid
$28,000.00 lower than the low bidder.
The equipment which wes proposed by the other four bidders is not inferior
equipment, but simply does not meet certain hardware configurations written into
the specifications.
CalTrans feels that if wewere to award the contract to the low bidder, both the
State and the City wouldbeopen to litigation frcmthe equi~mentmanufacturerwho
quoted to the 3rd low bidder on the basis of the specifications as written.
Apparently, the State has had previous problems with this type of litigation.

Consequently, Caltrans has rec~..Lended that it would be in the best interests of
the City of Tustin and the State of California if the project were readvertised.
In the m~antime, per CalTrans recommendations, the plans and specifications have
been revised to permit all signal controller wanufacturers to ~,~ete. The end
result could be a savings of some $28,000.00 in the cost of the project.
The revised schedule for this project is as follows:

ADVERtiSE FOR BIDS.

~Z~EREAS, it is the intention of the City Council of the City of Tustin,
? California to construct certain traffic signal improvements, street
improvements and appurtenant work on Irvine blvd. between Yorba Street and
8 Redh Hill Avenue designated as Irvine Blvd. FAU Project M-M023 (2);
9 WHEREAS, the City Engineer bas presented plans and specifications for
the construction of said work;

NOW THEREFORE, BE IT RESOLVED that the plans and specifications
presented by the City Engineer be and are hereby approved as the plans and
specifications for the construction of Irvine Blvd. FAU Project M-M023 (2).
BE IT FURI~ER RESOLVED that the City Clerk is hereby authorized and
13 directed to advertise as required by law for the receipt of sealed bids or
proposals for the doing of the work specified in the aforesaid plans and
14 specifications which said advertisement shall be substantially in the
following words and figures to-wit:

The foregoing quantities are approximate only, being given as a basis for
the comparison of bids, and the City of Tustin does not, expressly or by

i~plication, agree that the actual amount of work will correspond therewith,
3 but reserves the right to increase or decrease the amount of any class or
portion of the work, or to cmit portions of the work as may be deemed
4 necessary or advisable by the Engineer.
Plans, specifications and proposal forms to be used for bidding on this
project can only be obtained by prospective bidders at the office of the City
Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California, 92680, upon
payment of $15.00 per set, which ~nount shall be non-refundable.
Plans and specifications will be mailed out upon payment of $25.00 per
set, which amount shall be non-refundable.
9 In conformance with Section 37931 of the Government Code, all bids shall
be presented under sealed cover on the proposal form provided and accompanied
10 by one of the following forms of bidder's security:

a. Cash
b. Cashier's check made payable to th~ City of Tustin.
c. Certified check made payable to the City of Tustin.
d. Bidder's bond executed by an accredited surety insurer, made payable
to the City of Tustin.
14 The security shall be in an amount equal to at least ten percent (10%)
of the amount of the bid. A bid shall not be considered unless one of the
15 forms of bidder's security is enclosed therewith.

1 A Security Bond for payment of labor and materials will be required in
the amount of fifty percent (50%) of the estimated total contract price and a
2 Faithful Performance Bond in the amount of one hundred percent (100%) of the
estimated total contract price in the form attad~ed to the contract
3 documents. Said bonds shall be issued by a Surety Company rated grade A or
better and Class IX or better by the latest edition of Best's Key Rating
4 Guide.
City of Tustin reserves the right to reject any or all bids, and/or
waive any informality on a bid. No bidder may withdraw his bid for a period
of thirty (30) days after the date set for the opening thereof.
The contract will be awarded to the lowest qualified bidder.
8 Provisions of the State Contract Act are not applicable, and prospective
bidders will not be required to be prequalified.

All work to be done under the direct supervision of the City Engineer,
10 City of Tustin.

Ail work to be paid for at the unit prices bid frcm appropriated ~nies.
12 Federal Requirements and Federal minimum wages shall apply to this
project. Attention is directed to decision No. CA81-5154 of the Secretary of
13 Labor. Not less than said minimum wages shall be paid to workers ~loyed on
this project.

Federal requirements for this project require that the Contractor shall
15 perform work with his own organization which equals not less than 50 percent
of the total contract price.
Minimum wage rates for this project as predetermined by the Secretary of
17 Labor are set forth in the special provisions. If there is a difference
between the minimum wage rates predetermined by the Secretary of Labor and the
18 prevailing wage rates determined by the State for similar classifications of
labor, the Contractor and his subcontractors shall pay not less than the
19 higher wage rate.
20 Pursuant to Section 1773 of the Labor Code, the general prevailing rate
of wages in the county in which the work is to be done has bccn determined and
21 the Department has listed these wage rates in the Department of Transportation
publication entitled ~quipm~nt Rental Rates and General Prevailing Wage Rates,
22 dated February, 1977.
