Potential Withdrawal of Requests for Condominium Conversions and
I~act of Tenant Relocation Plans
The withdrawal of request by Tustin Arms II raised a question by Mayor Pro
Tem Kennedy as to the impact on tenants who were planning on relocation
because of the potential conversion. In the case of Tustin Arms II, any
tenant having notified the owner of termination prior to receipt of the
Acacia Equities letter of abandonment of the conversion would be eligible
for relocation payments. The remainder (approximately 30) would be faced
with loss of such payments and a rent increase in 30 days. All tenants who
had remained the 15 months since initial approval had their rents frozen
for the period and were substantially below the rent charged for units
which had been vacated. On any projects al ready approved, staff sees great
difficulty in requiring additional payments once the request is withdrawn.
Only three approved projects for conversion are pending; California
Apartments, Windsor Gardens and Rancho San Juan. All three still appear to
be moving forward toward conversion rather than candidates for withdrawal
of request. However, given the poor sales of existing converted units
throughout the County, and an increasing inventory of unsold units,
withdrawal remains a possibility.
If it is the Council's desire to grant greater protection to tenants of
future conversion proposals, a condition can be imposed on any such use
permit or variance request. Such a condition could require a fixed number
of days grace period following a withdrawal during which a imnant with
relocation plans could submit a termination notice and still receive a
relocation payment. The Council may desire not to take a position in this
regard at present but keep the concern in mind in the event of a future
application or to allow it to be a determination of the Planning Commission
once constituted.
