To extend Use Permit 81-23 for a period of one year
RECOI~ENDED ACTION
It is recommended that Use Permit 81-23 be extended for a period of
one year. The new expiration date will be July 20, 1983.
BACKGROUND
On July 18, 1977, the Planning Agency approved Use Permit 77-15,
authorizing the operation of a nursery school at the subject location
In July, 1981, another Use Permit for the subject site was approved. Use
Permit 81-23 authorized the applicant to add 3,530 square feet of floor
area to the existing nursery school to allow for a maximum of 144 students
(an increase of 84 students). As of this date, construction for the
expansion has not begun.
DI~USSION
The applicant is requesting a one year extension because he has been unable
to obtain the necessary financing to construct the approved expansion. As
of this date, no construction documents have been submitted for structural
plan check. The applicant has indicated that plans for the purposed
addition will be submitted and construction should begin by September,
1982.
In actions involving larger developments (i.e., Far West Savings & Loan
Building and the 41-unit condominium project on South "B" Street), the
Agency has only granted six-month extensions and has imposed the condition
that if the extended use permits/variances are not in effect within the
time alloted, re-applications and new public hearings will be required.
However, when the magnitude of the subject project, and the character of
the area are taken into consideration, whether the expansion is completed
in six months or one year is of very little consequence. Therefore, it is
recommended that Use Permit 81-23 be extended as requested.
