FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS -
ALLEY RECONSTRUCTION IMPROVEMENTS PROJECTS I, II, & III
RECOMMENDATION:
It is recommended that the Tustin Community Redevelopment Agency, at their meeting
of July 6, 1982, adopt the attached resolution accepting subject project and
authorizing the recordation of the Notice of Completion.
Assuming no claims or stop payment notices are filed within 30 days of the date of
recordation of the Notice of Completion, it is further recommended that the Agency
authorize payment of the final 10% retention amount ($8,238.02) at that time.
This amount together with previous payments of $74,142.22 represents 100% of the
final contract amount.
BACKGROUND:
Subject project encompassed reconstruction of alley pavement at three locations as
follows:
PROJECT I
PROJECT II
PROJECT III
Alley east of E1 Camino Real from Main to 3rd
Tract No. 3994 alley behind post office
Alley adjacent to E1 Camino Bank
The work has been completed to the satisfaction of the Engineering Division. The
contractor's performance was excellent, with only three complaints received during
the course of the work.
The preliminary contract amount based on estimated quantities was $80,741.58. The
final contract amount based on "as constructed" quantities is $82,380.24 for an
overrun on the contract of $1,638.66 or 2.0%. The primary cause for this overrun
was the fact that the original contract quantity for sawcut was in error.
Total expenditures for this project including design engineering and construction
engineering vs budgeted amounts are as follows:

RESOLUTION NO.
A RESOLUTION OF THE TUSTIN COMMUNITY
REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN
ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF
COMPLETION
WHEREAS, Porter Construction Co. Inc., having a contract
with the Tustin Community Redevelopment Agency to construct the
hereinafter described public work and improvement; and
WHEREAS, the City Engineer has duly certified to the
construction and completion of said public improvement
hereinafter mentioned in a manner satisfactory to the members of
the Tustin Community Redevelopment Agency of the City of Tustin;
and
WHEREAS, the Tustin Community Redevelopment Agency finds
that said contractor has completed said public improvement
hereinafter more particularly described in accordance with the
provisions of the contract documents and the notice of
completion and acceptance of said public work and improvement
should be filed and payment of the balance due said contract
authorized in accordance with the contract documents.
NOW, THEREFORE, BE IT RESOLVED by the Tustin Community
Redevelopment Agency of the City of Tustin that said pubic work
and improvement be, and the same is hereby accepted. Said
public work and improvement is more particularly described as
follows:
Alley' Reconstruction Improvements
Project I Alley east of E1 Camino Real between Main St.
& 3rd St.
Project II - Tract No. 3994 alley
Project III E1 Camino Bank alley between 3rd St. and
E1 Camino Real
AND BE IT FURTHER RESOLVED that the City Engineer of the
City of Tustin be, and is hereby authorized to execute and file
a notice of completion and acceptance of said public work and
improvement described herein as required by law.
