It is recommended the Agency approve Use Permit No. 82-19 by' the adoption
of Resolution No. 2039 as drafted.
BACKGROUND
In January, 1982, the commercial building at the subject address was
completed. Since that time, a large portion of the building has remained
vacant. The applicant is proposing to occupy one of the vacant suites with
a health spa, complete with exercise equipment, spa and massage treatment
rooms. Subject to the regulations of the Commercial General District (CG),
a conditional use permit is required for the proposed operation. A License
and Permit Board Hearing will be required prior to the massage portion of
the business going into operation.
DISCUSSION
As submitted, there are no apparent problems foreseen for a health spa use
at the subject location. The unit the applicant wishes to occupy is
alloted five (5) parking spaces that by Code will allow an occupancy of 15
persons. The applicant has indicated that a restriction limiting the
maximum occupany at any one time to 15 people is acceptable. It is
anticipated that the heaviest use of the facility will be after 5:00 p.m.,
therefore, any impact in terms of parking would be kept to a minimum.
It should be pointed out that the Agency is only acting on the suitability
of the subject site for a health spa use. The other details, regarding the
massage facilities, are subject to review and approval of the License and
Permit Board. Staff feels that the site is an appropriate one for a health
spa and thereby recommends approval. Should the Agency approve Use Permit
82-19, the spa could be in operation as soon as any interior building
modifications are completed, with the exception of the massage treatment
rooms which must not commence until after License and Permit Board Hearing.

A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, APPROVING USE PERMIT 82-19
GRANTING AUTHORIZATION FOR A HEALTH SPA TO
BE LOCATED 13762 NEWPORT AVENUE, SUITE D
The Planning Agency of the City of Tustin does hereby resolve as
follows:
I. The Planning Agency finds and determines as follows:
'A. That a proper application,(Use Permit No. 82-19), has
been filed by Long Thanh Nguyen requesting authorizing
to operate a health spa with exercise equipment and
massage facilities to be located at 13762 Newport
Avenue, Suite D.
B. That a public hearing was duly called, noticed and
held on said application.
C. That establishment, maintenance, and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals
comfort, or general welfare of the persons residing
or working in the neighborhood of such proposed use,
evidenced by the following findings:
1. That the use is in conformance with the
Commerical General District, and the Tustin Area
General Plan.
2. That the massage treatment aspect of the use will
be reviewed by the License & Permit Board.
D. That the establishment, maintenance, and operation
of the use applied for will not be injurious or detri--
mental to the property and improvements in the neighbor-
hood of the subject property, nor to the general welfare
of the City of Tustin, and should be granted.
E. Proposed development shall be in accordance with the
development policies adopted by the City Council, Uni-
form Building Codes as administered by the Building
Official, Fire Code as administered by the Orange County
Fire Marshall and street improvement requirements as
administered by the City Engineer.
F. That the subject project is categorically exempt from
the requirements of the California Environmental Quality
Act.
G. Final development plans shall require the review
and approval of the Community Development Department.

II. Planning Agency hereby approves Conditional Use
Permit No. 82-1g to authorize a health spa at 13762 Newport
Avenue, Suite D, subject to the following conditions:
The final site plan shall be standardized and reflect
all appropriate City standard drawing numbers. The
developer shall construct all missing or damaged street
improvements to said development per the City of Tustin
"Minimum Design Standards of Public Works" and "Street
Improvement Standards." This work shall consist of, but
is not limited to: curb and gutters, sidewalks, drive
apron and street pavement.
B. That maximum occupany of the facility at any one time
will not exceed 15 persons.
That the two exits must open in the direction of egress,
with no lock or latch except panic hardware.
Additionally, Fire Extinguisher(s), type 2AiOBC, must be
mounted not to exceed 75 ft. travel distance.

That the massage portion of the health spa shall not
commence operation until after approval of the License &
Permit Board.
E. All signing shall conform to the Approved Master Sign
Plan for the subject building.
PASSED AND ADOPTED at a regular meeting of the Tusttn Planning
Agency, held on the day of , 1982.
