FLEAGLE, D.P.A. ~- PROPOSED IRVINE-ELIZABETH WAY ANNEXATION NO. 130 RECOMMENDED ACTION: Adoption of Resolution No. 82-59 requesting LAFCO to commence proceedings for the proposed Irvine-Elizabeth Way Annexation No. 130. BACKGROUND: The Administrative Board of Aldersgate United Methodist Church on August 19, 1981 adopted the following motion: "The Administrative Board of Aldersgate United Methodist Church, requests that the property of Al dersgate United Methodist Church at 1201 S.E. Irvine Blvd. be annexed to the City of Tustin." A mail survey was conducted of the property owners and registered voters southerly of Wass Street between the existing city limits easterly of Newport Avenue and the esterly boundary of the church property. On the basis of the survey, it was determined that an inhabited annexation could not be completed without the necessity and expense of an election. The City Council then directed that an uninhabited annexation be processed for the church and adjoining properties. It is expected that several of the property owners on the easterly side of Elizabeth Way will file a protest with LAFCO and the City Council. However, the owners of the majority of the assessed value of properties within the area are supportive of the annexation and the protest may be over-ruled. The Council is further advised that Elizabeth Way is not a dedicated street and lacks public improvements. Upon completion of this annexation, property owners on the westerly side of Elizabeth Way will request that their properties be annexed to the City of Tustin. KF:dmt 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 RESOLUTION NO. 82-59 A RESOLUTION OF THE CITY COUNCIL, CITY OF TUSTIN, CALIFORNIA, REQUESTING THE COMMENCEMENT OF PROCEEDINGS FOR THE ANNEXATION OF UNINHABITED TERRITORY KNOWN AS IRVINE-ELIZABETH WAY ANNEXATION NO. 130 TO THE CITY OF TUSTIN Whereas, a request has been received from certain property owners abutting the city limits in the vicinity of Irvine Boulevard and Elizabeth Way to have their properties annexed to the City of Tustin; and Whereas, this request is made in the interest of a property owner who desires to more strongly identify with the community of which they are a part; and Whereas, said annexation proposal is a Class 19 Categorical Exemption from the requirements of an Environmental Impact Report; and Whereas, a Master Property Tax Transfer Agreement dated October 28, 1980 has been approved by the Board of Supervisors of Orange County and the City Council of the City of Tustin pursuant to Section 99(d) of the Revenue and Taxation Code of the State of California; Now, therefore, be it resolved by the City Council of Tustin, California that: 1. The Local Agency Formation Commission is hereby petitioned to initiate change of organization proceedings pursuant to Chapter 2, Article 1 of the Municipal Oranization Act of 1977 as an uninhabited annexation of territory containing less than 12 registered voters. 2. The territory is easterly of Elizabeth Way, southerly of Wass Street and north and south of 1trine Boulevard, as more fully described by the map and legal description attached hereto. 3. The proposed reorganization is for the purpose of creating community identity and extending municipal services to the subject territory. 4. The Master Agreement providing for the transfer of property tax revenues, as approved by the Board of Supervisors and the City Council on November 18, 1980, is applicable to the proposed Irvine-Elizabeth Way Annexation No. 130 to the City of Tustin as developed property.
