WICK, ASSISTANT CITY ENGINEER SUBJECT: SELECTION OF CONSULTANT TO PROVIDE CONSTRUCTION SURVEYING SERVICES FOR IRVINE BLVD. FAU PROJECT RECOMMENDATION: It is recommended that the City Council, at their meeting of July 19, 1982, select the firm of Greer and Company to provide subject services and authorize the Mayor to execute and the City Clerk to attest to the attached agreement. BACKGROUND: Subject construction engineering services consist of assisting the City survey crew in providing construction lay-out for the Irvine Blvd. FAU project, since it is felt that staff will not have enough available time to perform 100% of the surveying involved for this project. Requests for quotes to provide this service were sent out to four firms and were received back as follows Greet & Co. - .......... $5,510.00 Hayes & Associates ........ 5,760.00 Berryman & Stephenson Inc. - - - - 7,660.00 RDM Land Surveying ........ 8,140.00 Each firm based its quotes on parameters outlined and estimated man-hours involved as given by City staff. Costs could increase or decrease depending on the actual amount of time expended by the consultant on the project. This item of work is eligible for FAU participation and actual City cost will be 14% of the total monies expended for construction surveying services. Cost of construction surveying services has been included in funds budgeted for the Irvine Blvd. FAU project. Attached for the City Council's information are copies of quotes received from all four firms. DALE A. WICK ASSISTANT CITY ENGINEER db Attachments cc: City Clerk Finance Director CONSTRUCTION ENGINEERING SERVICES IRVINE BOULEVARD FAU PROdECT M-M023(2) SCOPE OF WORK / TASK I - will consist of providing line & grade stakes for center median curb & gutter between Prospect Avenue and Newport Avenue. Line & grade stakes will consist of nail & shiners set at a minimum of 25' O.C. and 1/3 delta on short curves. These will probably be set at a 3.0 foot offset out from the curb face. In addition, nail & shiners shall be set at all B.C. Is, E.C.'s, & P.R.C.'s. This task shall also include laying out of the sawcut line adjacent to center medians only (construction note No. 1). This will consist of painting a dash line on the existing pavement and could be done after the nail & shiners have been set. The criteria for all line & grade stakes will be that the station & cut or fill to top of curb be painted at each point and that the City and contractor be furnished with a cut sheet. Horizontal & vertical control for Task I has been previously established by the City and consists of the following: (al Benchmarks as indicated on Sheet No. 8 of the plans. (b) PK nails w/washer set on centerline Irvine Blvd. at 50' stations between centerline Prospect Ave. and centerline Newport Ave. (c) Stations 23+00, 26+98.35, 29+83.69, 32+34.88, 36+08.27, 39+00, 42+00, 48+00, and 50+50 have been tied out and tie sheets will be furnished. TASK II - will consist of aiding the City survey crew in setting finished pavement grades at the grade break point 12' out from the curb face as indicated on the typical section on Sheet No. 8 of the plans. The intent here is that after the existing pavement surface has been heater re-mixed and compacted, it will be necessary to paint finished pavement grade fills on each side of the street at said grade break at 50' stations. The time frame between the heater remix operation and the finished paving operation is very short and, consequently a minimum Of 2 and possibly 3 survey crews will be required to preclude delay to the contractor. The City will furnish one of the crews required. Horizontal & vertical control for Task II has been previously established by the City and consists of the following: (a) Benchmarks as indicated on Sheet No. 8 of the plans. (b) Each 50' O.C. station has been painted on the curb face on each side of the street. Thus, the requirement will be to measure out 12' from curb face at each station and, by utilization of a lenker rod, establish the fill. (c The City will furnish a tabulation of finished grade elevations at each grade break for every 50' station. "ENGINEER". , hereinafter referred to as W I T NE S SETH WHEREAS, CITY intends to engage the services of the ENGINEER to aid the CITY in performing construction survey and layout for Irvine Blvd. FAU Project M-M023(2); and WHEREAS, ENGINEER has submitted a proposal dated July 9, , 1982 to CITY to perform construction engineering services for Irvine Blvd. FAU Project M-M023(2); and WHEREAS, CITY desires to accept said proposal; NOW THEREFORE, in consideration of these premises, the parties hereto agree as follows: I. GENERAL A. CITY engages ENGINEER to perform the services hereinafter described in E'xhibit "A" for the compensation herein stated. B. ENGINEER agrees to perform said services upon the terms and conditions hereinafter set forth. C. ENGINEER represents that it employs, or will employ, at its own expense, all personnel required in performing the services required under this Agreement. D. ENGINEER agrees that all services required hereunder will be performed under its direct supervision, and all personnel engaged in the work shall be fully qualified and shall be authorized or permitted under State and local law to perform such services. The ENGINEER shall not sublet or transfer any work except as otherwise provided herein. -1- III. E. ENGINEER shall comply with all Federal, State and local laws and ordinances applicable to the work. II. Services to be Performed by ENGINEER ENGINEER hereby agrees to perform all the services as outlined in Exhibit "A" attached hereto and by this re'ference made a part hereof. Duties of CITY CITY hereby agrees to supply ENGINEER all information, data, ~eports, records and maps as are existing and available from the CITY, and necessary for carrying out the work outlined in Exhibit "A" hereof, without charge by CITY and CITY shall cooperate in every way reasonable in carrying out the work Without delay. IV. Right of Termination B. CITY may, by written notice to ENGINEER, terminate the whole or any part of this Agreement in any of the following circumstances: 1. If ENGINEER fails to perform the services called for by this Agreement or so fails to make progress as to endanger performance of this Agreement in accordance with its terms. V. Fee Schedule and Payment 1. The basis of payment for the services provided under this Agreement shall be as outlined in Exhibit "B" attached hereto. 2. The ENGINEER shall submit to the CITY during each month of the term of this agreement, a certified invoice for that portion of the work completed during that month. 3. Promptly after the receipt of each invoice, but in no event later than fifteen (15) days after receipt of said invoice, CITY shall make a payment of the approved invoice amount. -2- VI. VII. Hold Harmless ENGINEER shall indemnify and save harmless CITY the State of California and the Federal Government and their officers and employees, from any damage or liability arising from any errors, omissions, or negligence in ENGINEER's performance of this Agreement, or in the engineering work or services herein provided. Cost Accounting and Audits ENGINEER and his subconsultants shall maintain complete and accurate records with respect to costs incurred under this Agreement to include the records supporting cost proposals used to enter into a contract with CITY. All such records shall be maintained on a generally accepted accounting basis and sha]l be clearly identifiable. ENGINEER and his subconsultants shall make available to the representative of CITY, Caltrans, and FHWA, or their appointees, during normal business hours, all such bonds and records, and the right to examine and audit the same, and to make transcripts therefrom as necessary, and the ENGINEER and his subconsultants shall allow inspection of all work data, documents, proceedings, and activities related to the Agreement for a period of three (3) years from the date of final payment under this Agreement. ENGINEER and his subconsultants shall maintain records to show actual time and allowable costs with respect to each task set forth in the Exhibit "A" as required by Caltrans and FHWA. ENGINEER shall permit the authorized representative of CITY, the U.S. Department of Transportation and Comptroller General of the United States to inspect and audit all data and records of ENGINEER relating to his performance under this contract. -3- VIII. Reviews at appropriate stages during the work may be made by CITY, Caltrans, and FHWA. Civil Rights Act A. Compliance with Civil Rights Act. In connection with the execution of this contract, ENGINEER shall not discriminate against any employee or applicant for employment because of race, religion, color, sex or national origin. ENGINEER shall take affirmative actions to insure that applicants are employed and that employees are treated during their employment, without regard to their race, religion, color, sex or national origin. Such actions shall include, but not be )imited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. The applicable provisions of Executive Order 11246 relating to Equal Employment Opportunity by this reference are incorporated herein and made a part thereof. Wherever the word "contractor" appears to said Executive Order, it shall mean ENGINEER. B. Non-discrimination Civil Rights Act of 1964. ENGINEER, with regard to the work performed by it after award and prior to completion of the contract work, will comply with the regulations of the Department of Transportation relative to non-discrimination in federally-assisted programs of the Department of Transportation (49CFR21). C..Sanctions for Non-compliance. In the event of ENGINEER's non-compliance with the non-discrimination provisions of this contract, CITY shall impose such contract -4- sanctions as CITY, Caltrans or FHWA may determine to be apropriate~ including, but not limited 1. Withholding of payments to ENGINEER under this contract until ENGINEER complies; and/or 2. Cancellation, termination, or suspension of the contract, in whole or in part. In the event that legal action is commenced to enforce or declare the rights created under this Agreement, the prevailing party shall be entitled to an award of costs and reasonable attorney's fees in an amount to be determined by the court. IX. Assignment This Agreement shall be binding on the successors and assigned of the parties, but it shall not be assigned by ENGINEER without the prior written consent of CITY. X. Contractual Relationship ENGINEER shall be an independent contractor, not an employee of CITY. IN WITNESS WHEREOF, said parties have executed this Agreement as of the date and year first above written.
