HONORABLE hLAYOR AND CITY COUNCIL

ANNEXATION OF WATER UTILITY PROPERTIES
RECOMMENDED ACTION:
Adoption of Resolution No. 82-55, requesting the conmencement of
proceedings for the annexation of Tustin Water Utility properties.
BACKGROUND:
Section 35012 of the Government Code authorizes a city to annex
noncontiguous territory which is owned by the City and being used for
municipal purposes. If, after annexation, the City sells such territory,
it ceases to be a part of the City.
There are 13 water utility parcels being used as reservoirs or well sites
located in the unincorporated portion of the County. One well site is in
the City of Orange and one in the City of Santa Aha. These cities have
been requested to consent to the transfer of taxing authority pursuant to
Section 99(d) of the Revenue and Taxation Code. Pursuant to Article 13,
Section 11 of the California Constitution, properties owned by the City
will De exempt from property taxes after annexation to the City.
It may be of interest for the Council to know that the assessed value of
all but two of the water utility properties increased by 206% from base
year 1975 to 1982.
Resolution No. 82-55 has been prepared declaring a categorical exemption
from the California Environmental Quality Act and requesting LAFCO to
authorize the City to process the annexation without notice or hearing.
