FLEAGLE ~ ANNEXATION OF WATER UTILITY PROPERTIES RECOMMENDED ACTION: Adoption of Resolution No. 82-55, requesting the conmencement of proceedings for the annexation of Tustin Water Utility properties. BACKGROUND: Section 35012 of the Government Code authorizes a city to annex noncontiguous territory which is owned by the City and being used for municipal purposes. If, after annexation, the City sells such territory, it ceases to be a part of the City. There are 13 water utility parcels being used as reservoirs or well sites located in the unincorporated portion of the County. One well site is in the City of Orange and one in the City of Santa Aha. These cities have been requested to consent to the transfer of taxing authority pursuant to Section 99(d) of the Revenue and Taxation Code. Pursuant to Article 13, Section 11 of the California Constitution, properties owned by the City will De exempt from property taxes after annexation to the City. It may be of interest for the Council to know that the assessed value of all but two of the water utility properties increased by 206% from base year 1975 to 1982. Resolution No. 82-55 has been prepared declaring a categorical exemption from the California Environmental Quality Act and requesting LAFCO to authorize the City to process the annexation without notice or hearing. encs.: Resolution No. 82-55 Maps of territory to be annexed 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESGLUTI~N NO. 82-55 A RESOLUTIC~ OF ~HE CITY C~JNCIL OF ~HE CITY OF ~JSTIN, CALIFORNIA, REQUESTING THE COMMENCEMENT OF PROCEEDINGS FOR ~HE ANNEXATION AND REORGANIZATION OF CERTAIN NON- CC~TIGUOUS UNINHABIT~u AREAS DESIGNAT~U AS "TUSTIN WATER UTILITY ANNEXATION NO. 131" TO ~HE CITY OF TJSTIN WHEREAS, the City of Tustin has acquired the facilities and opera- tions of the Tustin Water Works, and WHEREAS, Sections 35012 of the Government Code authorizes cities, upon the approval of the Local Agency Formation C~mlssion, to annex non- contiguous territory not exceeding 160 acres in area which is owned by the City and is being used for municipal purposes, and WHEREAS, a request has been made to the cities of Orange and Santa Aha for consent to the reorganization and transfer of property tax pursuant to Section 99 of the Revenue and Taxation Code for properties within their incorporated limits, and WHEREAS, subject properties will be exempt after annexation to the city pursuant to Article 13, California Constitution, and from property taxes Section 1 1 of the NOW ~HEREFORE, BE IT RESOLVED by the City Council, City of Tustin, California that: The City Council hereby adopts a 9~solution of Application for annexation and reorganization proceedings of said unin- habited territory owned by the City and used for municipal purposes pursuant to Section 35100 (b) of the Government code · II. Said uninhabited territory be, and is hereby designated as the "Tustin Water Utility Annexation No. 131" to the City of Tustin and shown on Exhibit "A" attached hereto and incorpo- rated herein by this reference, consisting of Parcels A through L and as legally described by said exhibit. III. Proposed change of organization is for the purpose of reducing th~ tax liability of city owned property used for municipal purposes. IV. Services to said properties consist of maintenance and ser- vice of the Water Utility facilities and weed abatement by City forces · WHEREAS, the City Council has determ2tned that the proposed annexa- tion of the Water Utility sites are classified as a Class 19 Categorized Exemption pursuant to Section 15119 of the Guidelines for implementation of the California Environmental .Quality Act of 1970. 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTI~ NO. 82-55 Page 2 V. The Local Agency Formation Com~ssion is hereby petitioned to conduct a hearing' and make a determination pursuant to Chapter 2, Article 5, Section 35150 Of the Municipal Organi- zation Act of 1977, designating the City of T~stin as the conducting authority to annex said territory without notice or hearing. 5 VI. The Master Agreement providing for the transfer of property tax revenues, as approved by the Board of Supervisors and the City Council on November 18, 1980,'and applicable resolutions of the City of Orange and the City of Santa Ana are appli- cable to the proposed reorganization and T~stin Water Utility Annexation No. 131 to the City of Tustin. VII. Required filing fees payable to the Local Agency Formation Commission are hereby authorized.
