MINUTES 08-02-82 (2)TUSTIN PLANNING AGENCY Minutes of Regular Meeting July 19, 1982 The Planning Agency held a regular meeting Monday, July 19, 1982, at 3:00 p.m. in the Council Chambers of the City Hall, 300 Centennial Way, Tustin, California. The meeting was called to order by Chairman Edgar at 3:02 p.m. The Pledge of Allegiance was led by Mrs. KennecLv and the invocation was given by Mr. Greinke. PUBLIC HEARINGS: Applicant: Location: Request: USE PERMIT 82-17 Collins International Foods 1022 E. First Street To add a drive-thru window to the existing Kentucky Fried Chicken Restaurant After presentation of the staff report, Chairman Edgar opened the Public Hearing at 3:04 p.m. Bob Merriam, designer for the project, s~ated that of the two methods suggested for dealing with pedestrian traffic across the drive lane, he would prefer to see a striped pedestrian lane and a stop sign for vehicles, instead of a wall extending to the public sidewalk. The Public Hearing was closed at 3:06 p.m. After Agency discussion regarding the possibility of using hedges or landscaping as a pedestrian barrier, Mr. Hoesterey moved approval of Use Permit 82-17 with the condition that a striped pedestrian lane and stop sign for vehicles be provided. Mr. Greinke seconded with the suggestion that if problems arise, the applicant consider the possibility of erecting a pedestrian barrier. USE PERMIT 81-18 & TENTATIVE TRACT MAP NO. 11752 Applicant: Location: Request: David Jeffers. 1971Ren Circle Authorization to convert a residential duplex building into condominium units After presentation of the staff report, Chairman Edgar opened the Public Hearing at 3:13 p.m. Planning Agency Minutes July 19, 1982 Page 2 Carol Sheber, 1952 Ren Circle, asked the Agency if adequate parking was provided for the project and, as many other property owners in the area were interested in similar actions, if a blanket rezoning or permit could be issued. After Agency and staff discussion, the Agency determined that adequate parking was available and each property owner would have to apply individually. The Public Hearing was closed at 3:19 p.m. Mr. Saltarelli stated he felt the use was not appropriate and moved denial of the request. Mr. Hoesterey seconded. Motion failed: 2-3 AYES: NOES: ABSENT: HOESTEREY, SALTARELLI EDGAR, GREINKE, KENNEDY None Mr. Greinke moved approval of Use Permit 81-18 and Tentative Tract Map No. 11752 by the adoption of Resolution 2045. Mrs. Kennedy seconded. Motion carried: 3-2 AYES: NOES: ABSENT: EDGAR, GREINKE, KENNEDY HOESTEREY, SALTARELLI None 3. USE PERMIT 82-19 Applicant: Location: Request: Long Thanh Nguyen 13762 Newport Avenue, Suite D Authorization to operate a health spa After presentation of the staff report, Chairman Edgar opened the Public Hearing at 3:32 p.m. Frank Heller, attorney for the applicant, stated the operation Was intended to be a health spa, not a massage parlor and the greatest use of the facility would be after 5:00 p.m. Mr. Hoesterey questioned the adequacy of parking at this small, mixed-use (office/retail) facility. It was determined that up to four employees (two per shift) would accommodate customers in the three treatment rooms, spa and exercise center. Mr. Hoesterey said 'that only five spaces is insufficient to allow this use in this location. The Public Hearing was .closed at 3:43 p.m. Mr. Saltarelli moved denial of the request. Mr. Hoesterey seconded. Motion carried: 5-0 AYES: NOES: ABSENT: 4. EDGAR, GREINKE, HOESTEREY, KENNEDY SALTARELLI None None AMENDEMENT TO USE PERMIT 80-3 & TENTATIVE TRACT MAP 11829 Applicant: Location:. Request: Burnett-Ehline Southeasterly corner of Irvine Blvd. & Holt Ave. Authorize proposed office building to subdivide into commercial condominiums After. presentation of the staff report, Chairman Edgar opened the Public Hearing at 3:45 p.m. Planning Agency Minutes July 19, 1982 Page 3 Jack Hardy, representative of Burnett-Ehline stated the request to convert to condominiums was to offset the cost of the building. Responding to a question from Mr. Greinke, he estimated the project would be complete in 9-12 months. The Public Hearing was closed at 3:49 p.m. Mrs. Kennedy and Mr. Hoesterey expressed a desire to explore the possibility of altering the architectural design to allow- compatibility with the surrounding Old Town Tustin. It was determined that if the project came back to the Agency for review, those concerns could be addressed. Mr. Saltarelli moved approval of the amendment to Use Permit 80-3 and Tentative Tract May 11829. Mr. Edgar seconded. Mrs. Kennedy requested the minutes record the concerns regarding architectural design of the structure. Motion carried: 5-0 AYES: NOES: ABSENT: EDGAR, GREINKE, HOESTEREY, KENNEDY SALTARELLI None None PUBLIC CONCERNS: Carol Sheber, 1952 Ren Circle stated she was glad to see the Agency take the action it had with regard to Use Permit 81,19, authorizing the conversion of the residential duplex into condominium units. OLD BUSINESS: 1. Resolution of Approval for Communicom for Use Permit 82-16 Mrs. Kennedymoved adoption of Resolution No. 2041. Mr. Saltarelli seconded. Final Tract No. 11428 - Frank Luizzi Mr. Saltarelli moved adoption of Resolution No. 2040 recommending to the City Council, approval of Final,Tract Map 11428. Mr. Hoesterey seconded. Motion carried: 4-1 AYES: EDGAR, GREINKE, HOESTEREY, SALTARELLI NOES: KENNEDY ABSENT: None 2. Tenant Relocation Plan for Windsor Gardens Mr. Saltarelli moved approval of the Tenant Relocation Plan for Windsor Gardens as submitted. Mr. Greinke seconded. Motion carried: 5-0 AYES: NOES: ABSENT: EDGAR, GREINKE, HOESTEREY, KENNEDY SALTARELLI None None STAFF CONCERNS: None. AGENCY CONCERNS: Chairman Edgar questioned Mr. Rourke about the status of the fire safety ordinance.
