Location: 1082, 1092, 1102 and 1112 San Juan RECOR4E#D£D ACTION Recommend approval to the City Council of Tentative Tract No. 11582 by the adoption of Resolution No. 2046. BACKGROUND & DISCUSSION Revised Tentative Tract Map No. 11582 consists of approximately 1.038 acres which is being subdivided into one lot for condominium purposes. The conditions of approval are listed in Resolution No. 2046. Condition II "6" states that the City should proceed to abandon the southerly + 3 feet of San Juan right-of-way. This street presently exists as a 33Toot half- street; the proposed street improvements to be constructed along San Juan with the development will require only 30 feet of right-of-way. Consequently, it is recommended that the City abandon the southerly 3 feet of the street right-of-way. The Tentative Map should be revised to show the right-of-way as 33 feet and the potential for the three foot abandonment. The General Plan shows this area as multiple-family, therefore, this map is in conformance with the Tustin Area General Plan. A public hearing (Variance 82-8) was heard on August 2, 1982 to authorize the development of the 26 residential condominiums. If the Variance was approved, then it would be appropriate to consider the map at this time. The Planning Agency finds and determines as follows: A. That a proper application was filed by Joseph Truxaw and Associates on behalf of Mark Ainslie et. al. pursuant to the provisions of the Subdivision Ordinance No. 84? for the purpose of creating 18 lots from lots 1, 2, 3, 4, and 5 in Block A of Martin's addition as recorded in Book 19, Page 79 of Miscellaneous Records of Los Angeles County. B. That said map is in conformance with the Tustin Area General Plan. C. A Negative Declaration was previously approved to conform with the California Environmental Quality Act. II. The Planning Agency hereby recommends approval of revised Tentative Tract Map No. 11582, subject to the following conditions: 1. Submission of CC&R's to the City Attorney's office for review and approval prior to any Councl action on the final tract map. 2. Provision for an individual sanitary sewer and domestic water service to each proposed condominium unit. 3. Submission of a final grading plan for review and approval. 4. Preparation of improvement plans for an construction of the following public works improvements to the satisfaction of the City Engineer: a. Street paving b. Curb and gutter c. Sidewalk d. Payment of the following fees: a. Orange County Sanitation District no. 7 in the amount of $250/dwelling unit. b. East Orange County Water District in the amount of $500/dwelling unit. 6. Revision of Tentative Tract Map to reflect 33 feet of street right-of-way along San Juan Street and that the City proceed to abandon the southerly~3 feet of the street right-of-way. 7. Payment of Parkland Dedication Fees. PASSED AND ADOPTED at a regular meeting of the Planning Agency of the City of Tusitn held on the day of , 1982. Richard B.
