TO: FROM: SUBJECT: Honorable Mayor and City Council William Huston, City Manager Disability Retirement - Kris M~rrison The Disability Review Board, comprised of Ron Nault, Royleen White and myself held a hearing on Friday, July 2, 1982 regarding the matter of Kris Morrison's disability retirement. The retirement action was initiated by the City based on Officer Morrison's continuing medical and psychological problems culminating in her release from active duty on September 9, 1981. The board reviewed the relevant medical reports including the most recent report from Dr. Albert J. Rosenstein, her psychologist, on 2/16/82 who rated her as "Permanent and Stationary with her condition moderate-severe." With this disability rating on a permanent basis, Kris would be considered to be permanently disabled from the position of Police Officer. In reviewing the question of causation, it was felt there was sufficient reference in the medical reports to the Job-related nature of Kris' injuries to firmly establish that she has an industrially caused injury (condition) for the purpose of retirement under the guidelines of the Public Employees Retirement System. Based on the results of the hearing, it is recommended to the Council that ~ou-approve the attached resolution regarding Kris Morrison's retirem~nt, establishing 2/16/82 as the effective date of her retirement and establishing her retirement as being the result of a job-related disability. WAH/kaf ? 8 10 11 12 15 17 18~ 19 2O 21 2§ 27 28 RESOLUTION NO. 82-63 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, PERTAINING TO THE DISABILITY RETIREMENT OF KRIS MORRISON (SECTION 21025, GOVERNMENT CODE) WHEREAS, the City of Tustin, California (hereinafter referred to as Agency) is a contracting agency of the Public Employees' Retirement System; WHEREAS, the Public Employees' Retirement Law requires that a contracting agency determine whether an employee of such agency in employment in which she is classified as a local safety member is disabled for purposes of the Public Employees' Retirement Law and whether and whether such disability is "industrial" within the meaning of such Law; WHEREAS, an application for disability retirement of Kris Morrison employed by the Agency in the position of Police Officer has been filed with the Public Employees' Retirement System; WHEREAS, the Disability Retirement Board of the City of Tustin conducted a hearing on July 2, 1982, and found that Kris Morrison is disabled as a result of industrial causes; WHEREAS, the City Council of the City of Tustin, California has reviewed the Findings and conclusion of the Disability Retirement Board; (1) NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Tustin, California, find and determine and it does hereby find and determine that Kris Morrison is incapacitated within the meaning of the Public Employees' Retirement Law .for performance of her duties in the position of Police Officer; and (2) BE IT FURTHER RESOLVED THAT THE City Council find and determine and it does hereby find and determine that such disability is a result of 1 $ 5 6 7 8 9 10 11 12 14 15 !7 18 19 2O 21 22 24 25 27 28 injury or disease arising out of and in the course of emploj~nent and neither said Kris Morrison nor the City of Tustin has applied to the Worker's Compensation Appeals Board for a determination pursuant to Section 21026 whether such disability is industrial; and (3) BE IT FURTHER RESOLVED that the effective date for member's seperation from her employment in the position of Police Officer is February 16, Z982.
