RECOMMENDATION:
That the Tustin City Council, at their meeting of July 19, 1982, introduce the
attached Ordinance which revises the prima facie speed limit on Main Street and
Bryan Avenue as indicated below:

The radar study has indicated that the section between B Street and Prospect
k~_Avenue has an 85th percentile of 40 MPH. Due to the narrowing of the lanes,

considerable parking, and pedestrians crossing at various locations other than the
intersection, it is recommended that this section be zoned at 30 MPH.
The 85th percentile for the section of roadway between Browning Avenue and Myford
Road would indicate a posted speed limit of 55 MPH. It is recommended that this
section be posted for 45 MPH due to the lack of a shoulder and the large drainage
ditch on the north side of the roadway, which would force a stalled vehicle to
block the westbound travel lane and would be unexpected by the motorist.
The recommendations for the other sections follow the 85th percentile speeds
indicated by the radar survey.
These speed zones will provide for the use of radar as an enforcement tool.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, REVISING PRIMA FACIE SPEED LIMITS ON
CERTAIN STREETS.
1. It is hereby determined that the speed permitted by State law as
applicable upon the following streets is other than is reasonable and it is .
hereby declared that the prima facie speed limit shall be as herein set forth
on those streets, or parts of streets, herein designated when signs have been
erected giving notice thereof.
2. The prima facie speed limit for vehicular traffic on the following
streets, or portions of streets, is hereby established as hereinafter set
forth, effective when signs have been erected giving notice thereof.
3. Provided, further, however, that in any instance where the prima
facie speed limit as fixed by the vehicle code of the State of California is
less than the prima facie speed limit hereby determined and fixed, then the
prima facie speed limit which is provided in the Vehicle Code shall be
applicable.
4. The streets, or portion of streets within the Tustin City limits,
affected and the declared prima facie speed limit shall be as follows:

WHEN WILL A LOWER SPEED LIMIT BE POSTED ON MY STREET?
A common belief is that posting a speed limit will influence drivers to drive at that speed.
The facts indicate otherwise.
Research conducted in many parts of this country over a span of several decaaes has
shown that drivers are influenced more by the appearance of the highway itself and the
prevailing traffic conditions than by the posted speed limit.
California's Basic Speed Law requires that:
"No person shall drive a vehicle upcn a highway at a speed greater than is resoonsible or
prudent having due regard for weather, visibility, the traffic on, and the surface and width
of the highway, and in no event at a speed which endangers the safety of pe;sons or
property."
Under California law, the maximum speed Emit for any passen?r vehicle is nc'.v, 55 miles
per hour. A;I other speed limits are called prima facie limits, which "on the ~ace of !~" are
safe and prudent under normal conditions. Certain prima facie limits are estaDlisSed b'./

alleys, at blind intersections and blind railroad crossings and a part-tim? 25 .?;F'H tin,it in
school zones when children are going to and from school. These speeds ~,r<- not a~w~ys
posted but all California motorists are required to know these basic 15. 25, and ,55 mile

Intermediate speed limhs between 25 and 55 miles per hour may be established hy ioc~i
authorities cn the basis of traffic engineering surveys. These surveys inc!ude an ?naiysis
of roadway conditions, accident records, and the prevailing speed of prt~dent drive-s, ii
speed limit signs are posted for a lower limit than is neeri~.d to safel'~' me,_t those
conditions, man,/ drivers will simply ignore the signs. At the same time, other drivers wil',
stay ~ithin the posted limits. This generally increases the conflicts betv.,~en faste~ and
slower drivers, reduces the gaps in traffic through which
crossings could be made safely and increases the difficuhy for
pedestrians to judge the speed of approaching vehicles.
Studies have shown that where uniformity of speed is not
mainta ged, accidents generally increase.
