BACKGROUND & DISCUSSION The subject property is developed as a fast food facility (Taco Bell) which was constructed in June, 1970. The property has been in the retail commercial district since the initial passage of the Zoning Code in 1961. Taco Bell has made a request for a drive-thru service window on the northern side of the building. Drive-thru restaurants are not authorized in the C-1 District (Section 9232a2(o)). Drive-thru restaurants can be authorized in the Central Commcercial (C-2) and Commercial General (CG) by use permit approval. This zone change approval in no way implies approval of a future use permit. The area has a mixture of old and new commercial developments, the most recent being a two-story office building just southwest of this site. Over the years, traffic has increased along this section of Newport Avenue to 26,250 vehicle trips per day and 7,100 trips on Mitchell Avenue. FINDINGS & CONCLUSIONS The area has developed from a neighborhood commercial area to a strip commercial district. All indications are that the area will continue to intensify in commercial development. The traffic volumes along Newport Avenue are consistent with existing volumes in the City's central business area. The Commercial General District is the most recently developed zoning classification which was devised by the City to aid in the growth of commercial areas while providing mitigating measures for possible increased environmental impacts. The Commercial General District, which allows a larger range of uses, does apply to a great degree of control by the City in the form of performance standards on developments. That a proper application, (Zone Change 82-2), has been filed by Taco Bell on behalf of Realty Income Properties to rezone the property at 14232 Newport Avenue from the current Retail Commercial (C-1) District to the Commercial General (CG) District. B. That a public hearing was duly called, noticed and held on said application. C. That a zone change should be granted for the follow- reasons: The character of the development in the area has changed since the initial Zoning Code adoption from neighborhood commercial area to a strip commercial district. 2. Traffic volumes have Increased to a level which justifies a greater range of allowable uses. The Commercial General District will allow for the expansion of commercial uses but will ensure the orderly development through the imposition of district development standards. O. Development of subject property shall be in accordance with the policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Code as administered the Orange County Fire Marshal; and street improve- ment requirements as administered by the City Engineer. E. Final development plans shall require the review and approval of the Community Development Director. F.
