ADJUST 82-1 08-16-82DATE: AUGUST 10, 1982 Inter-Com TO: FROM: SUBJECT: WILLIAM HUSTON, CITY MANAGER BOB LEDENDECKER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER LOT LINE ADJUSTMENT NO. 82-1 (135 & 185 PROSPECT AVENUE) RECOMMENDATION: That the Tustin City Council, at their meeting of August 16, 1982, adopt the attached resolution approving Lot Line Adjustment No. 82-1, subject to the execution of a covenant and agreement to hold the two Schmetzer parcels as one. BACKGROUND: Mr. Thomas Wilkie and the Schmetzer family are requesting a lot line adjustment between their two parcels located at 135 and 185 Prospect Ave respectively. This requested adjustment will transfer a four (4.0) foot wide strip of land from the Schmetzer parcel to the Wilkie parcel to provide adequate vehicular access to the back portion of the parcel along the southerly side of the building located on the Wilkie parcel. DISCUSSION: This lot line adjustment process is provided for in Section 66412(d) of the Subdivision Map Act wherein the act makes provisions for the local agency to approve lot line adjustments where the land taken from one parcel is added to an adjacent parcel and where a greater number of parcels than originally existed is not thereby created. The attached documents, consisting of a resolution and three sheets of an application for lot line adjustment, will provide this adjustment once the resolution has been adopted by City Council, the application approved by staff, and when all documents have been recorded by the County Recorder's Office. This process and these documents have been reviewed and approved by the City Attorney's Office. This application has been reviewed by both the Community Development Department and the Engineering Division and all proposed adjustments have been found to be in compliance with all zoning and setback requirements of the City and the provisions of the California Subdivision Map Act. The Schmetzer parcel consists of two separate lots which will require the execution and recordation of a covenant and agreement to hold both lots as one parcel to eliminate the creation of a lot with substandard frontage width. That the proposal is eligible for processing as a lot line adjustment pursuant to Section 66412 of the Subdivision Act; 2. That the requirements of the California Environmental Quality Act have been met; 3. That the proposal is consistent with the General Plan; and 4. That the resultant parcels will meet the requirements of the Zoning Code; NOW, THEREFORE, BE IT RESOLVED that the proposed Lot Line Adjustment No. 82-1 as shown on Exhibits A and B is hereby approved and that the parcels be considered building sites upon recordation of this document.
