HomeMy WebLinkAboutNB 1 ST DEDICATION 08-16-82 NEW BUSINESS DATE 10, 1982 ~ I ~t~" '~ C O~ FROM: SUBJECT: WILLIAM HUSTON, CITY MANAGER BOB LEDENDECKER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER REQUEST FOR STREET DEDICATION WAIVER RECOMMENDATION: In the event the City Council is desirous of proceeding with the widening of the northerly side of Seventeenth Street between the Costa Mesa (Newport) Freeway and Prospect Avenue north to its ultimate major arterial street width, then it is recommended that the request for street dedication waiver be denied. BACKGROUND: Manny's Coffie Shops has submitted a site plan for the construction of a new kitchen facility at their location of 17231 E. Seventeenth Street. As a part of the plan review process, certain conditions were requested by the Engineering Division per routine and standard City policies/requirements. A copy of the staff report is attached for your information. Item No. I of this report requests the dedication of a ten foot wide parcel of land across the Seventeenth Street frontage of the subject parcel. DISCUSSION: Staff has received a letter from Mr. Thomas M. Simms of Manny's Coffee Shops requesting a waiver to the street dedication requirement (copy attached). As indicated in Mr. Simms' letter, their firm is a leasee of the subject property and has no control of the dedication. The property owner, Mr. Wilde, has indicated that he is not willing to dedicate the subject property (10 ft. wide strip) for street widening purposes. Seventeenth Street is presently classified as a major arterial highway (60 ft. half street) in the City and County arterial masterplan of highways. At the present time, the area adjacent to Manny's Coffee Shop is developed and dedicated to a primary arterial highway width (50 ft. half street). The southerly side of Seventeenth Street is presently dedicated and developed to the major arterial highway status between the Costa Mesa (Newport) Freeway and Prospect Avenue south. The northerly side of Seventeenth Street between the Costa Mesa (Newport) . Freeway and JoJo's Restaurant and from Laurinda Way to Prospect Ave. north is developed to a primary width highway. The areas along the north side of Seventeenth Street between Yorba Street north and Treehaven Ave. and from 150~ ft. easterly of Laurinda Way and Prospect Avenue north have already previously been dedicated to the ultimate right-of-way. At a workshop session in March, 1982 and also at a recent budget workshop session, Council has expressed a desire to widen the northerly side of Seventeenth Street between the Costa Mesa (Newport) Freeway and Prospect Avenue north to its ultimate width as a major arterial highway. REQUEST FOR STREET DEDICATION WAIVER AUGUST 10, 1982 PAGE TWO Current City policy requires the dedication or irrevocable offers of dedication of street rights-of-way when any of the following occurs on a parcel of land: 1. Development of a new structure or site development. 2. Modification of an existing structure wherein the. assessment evaluation is increased by 50% or more. The proposed development appears to be a kitchen facility that could be utilized for a central kitchen-type facility for other Manny's Coffee Shops and not exclusively for the facility at 17231 Seventeenth Street. The estimated value of land requested for dedication is as follows: 10 ft. x 181 ft. of frontage = 1810 sq. ft. 1810 sq. ft. x $18.00/sq. ft. ~ $32,580 In the event the right-of-way is not dedicated at this time, an additional amount of $32,580 plus acquisition costs will have to be included within the project budget. I am writing to you pursuant to our phone conversation of last Thursday. Your time and attention was much appreciated. As I explained to you then, we received your letter listing conditions to be fulfilled before we could receive a building permit for our kitchen extension. Ell conditions can be fulfilled without delay except for your re.c~uest that the land- lord dedicate 10 feet of property frontage on 17th Street, Tustin. I contacted our landlord Mr. Wilde, and discussed the dedication with his representative, Mr. Frank Bueche. Mr. Bueche stated that Mr. Wilde's position is that he is not willing to dedicate the subject property. Hence my phone call to you last week. We, as the tenant on the subject property, wish to make improvements to the building located thereupon by expanding and remodeling the existing Manny's restaurant. The restaurant is 15 years old and definitely can use such improvements. We will have a first cabin, high volumn "Mimi's Cafe" operation when completed. The higher volumn, of course, will mean higher tax revenues for Tustin. As tenants, however, we are in the middle between Mr. Wilde and the City of Tustin concerning the dedication. We have no control over either entity. Our lease does not entitle us to dedicate any part of the subject property. We are requesting a hearing or meeting, whatever the case, for the purpose of discussing the recission of the requirement of dedication. No widening improvements will be required at this time. This widening will require the ultimate loss of three parking spaces. Will the new building require a separate sanitary sewer or domestic water service? If so, these connections should be shown on the final site/grading plan. 3. Orange County Sanitation District No. 7 sewer connection fees will be required on Parcel 2 of P.M. 81-1028 in the amount of $250.00. e Payment of East Orange County Water District fees may be required on Parcel ;lo. 2 of P.M. 81-1028. Contact Earl Rowenhorst of the Tustin Water Service for fee amounts. 5. Completion or replacement of all missing or damaged street improvements, including, but not limited to, the following: a.
