RECOR4ENDED ACTION
Staff recommends that the Agency adopt Resolution No. 2051 recommending to
the City Council that Zone Change 82-4 be approved.
BACKGROUND
In June, 1979, the subject properties were brought into the City as a
portion of Annexation Number 120 and were pre-zoned R-3 to conform with the
General Plan at that time.
On June 7, 1982, General Plan Amendment 82-1(A) was given final approval by
the City Council. That action changed the General Plan designation for the
subject properties from residential to commercial. The matter now before
the Agency concerns the zone change that is required to bring zoning into
conformance with the amended General Plan.
DISCUSSION
During the course of public hearings, residents of the condominium project
on "B" Street voiced concern about the potential for undesireable
commercial development occuring near their homes as a result of the General
Plan Amendment. At that time, it was pointed out that to mitigate the
impacts of commercial development, the implementing zone designation would
be such that Planning Agency review and approval would be required prior to
development. Further, staff is of the opinion that because of the locaiton
and configuration of the lots, Planning Agency review should be required
regardless of the "desirability" of the development.
The recommendation for the CG-PUD zone is based in part on these concerns,
but it is also considered appropriate as the development standards for the
CG Districts are at least as restrictive as the other commerical zones and
in some instances, more so. It is felt CG-PUD is the most appropriate
designation for these specific properties and Zone Change 82-4 should be
approved.

A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, RECOMMENDING TO THE CITY
COUNCIL OF THE CITY OF TUSTIN, THE RE-ZONING
OF THE PROPERTIES LOCATED AT 17311, 17341
MCFADDEN STREET FROM MULTIPLE-FAMILY RESIDENTIAL
DISTRICT (R-3) TO COMMERCIAL GENERAL-PLANNED UNIT
DEVELOPMENT (CG-PUD) DISTRICT
Agency of the City of Tustin does hereby resolve as
I. The Planning Agency finds and determines as follows:
Ao That a proper application (Zone Change 82-4) has
been filed by the City of Tustin to re-zone the
properties at 17311 and 17341 McFadden Street from the
current Multiple-Family Residential (R-3) District to
the Commerical General-Planned Unit Development (CG-PUD)
District.
B. That a public hearing was duly called, noticed and
held on said application.
C. That a zone change should be granted for the
following reasons:
1. That the Tustin Area General Plan currently
designates the subject properties as Commercial.

That in order to bring the subject properties into
conformance with the General Plan, a zone change to a
Commercial District is required.

The Commercial General-Planned Unit Development
District will allow for the development of commercial
uses but will ensure the orderly development through
the imposition of district development standards, and
by review and approval of the Planning Agency.
D. Development of subject property shall be in
accordance with the policies adopted by the City
Council; Uniform Building Codes as administered by the
Building Official; Fire Code as administered by the
Orange County Fire Marshal; and street improvement
requirements as administered by the City Engineer.
E. Final development plans shall require the review and
approval of the Community Development Director.
F. That a Negative Declaration was previously approved
to comply with the requirements of the California
Environmental Quality Act.

II.
The Planning Agency hereby recommends to the City
Council, approval of Zone Change 82-4 from Multiple
Family Residential (R-3) to Commercial General-Planned
Unit Development (CG-PUD) for the properties located at
17311, 17341 McFadden Street.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Agency held on the day of , 1982.
