Authorization to provide drive-thru service from an existing
fast food facility in accordance with the Commercial General
District (CG) standards.
BACKGROUND
The subject property was developed as a fast food facility (Taco Bell)
which was constructed in June, 1970. On August 2, 1982 the Planning Agency
recommended a change in zoning for the property from the Retail Commercial
(C-1) District to the Commercial General (CG) District. The proposed zone
change is to be reviewed by the City Council at the September 7, 1982
evening meeting and it would be appropriate for the Planning Agency to
consider the subject proposal.
DISCUSSION
The development plans indicate the following changes. A drive-up service
window is to be added on the north side of the restaurant. A one-way
drive-thru lane would be provided from the southern parking area, around
the rear of the building to the service window.
The drive-thru lane has sufficient stacking area for five (5) autos and a
combination menu and communication board will be provided at the entrance
to the lane.
Vehicles would exit the site onto Newport Avenue from the northern parking
area. The drive-thru lane will be separated from the parking area by new
planting islands.
In this plan, walk-in trade from the northern parking area wilt have to
travel across the exit point of the drive-thru lane. Working with the
design limitations of an existing development, this condition can not be
easily modified. To reduce the potential hazard, it is recommended that a
striped pedestrian lane be installed across the drive-thru lane to the
public entrance.

The minimum parking accommodation required by Code is sixteen (16) spaces.
Seventeen (17) spaces are provided. The small structural additions are
compatible with the building's existing architectural style.
Two (2) directional signs per driveway have been indicated for
installation. The Sign Code only permits one per driveway. The applicant
has requested drive-thru service advertisement on the existing pole sign.
Such an addition should be designed to be compatible with the existing
style and be limited to twelve (12) square feet. With such an addition,
the single face area of the pole sign would be thirty-seven (37) square
feet.
Additional concerns and recommended conditions of approval are contained in
the accompanying draft resolution.
RECOI~ENDED ACTION
Staff believes the project to be well designed and would.therefore
recommend approval of Use Permit 82-21 by the adoption of Resolution No.
2052.

A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, AUTHORIZING THE 'DEVELOPMENT
OF A DRIVE-UP SERVICE WINDOW AT AN EXISTING
FAST FOOD FACILITY AT 14232 NEWPORT AVENUE
The Planning Agency of the City of Tustin does hereby resolve as
follows:
I. The Planning Agency finds and determines as follows:
A. That a proper application (U.P. 82-21) was filed by
Taco Bell on behalf of Realty Income Properties
requesting authori£ation to construct and operate a
drive-up service window at an existing fast food
restaurant at 14232 Newport Avenue
B. That a public hearing was duly called, noticed and
held on said application.
C. That establishment, maintenance and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals,
comfort or general welfare of the persons residing or
working in the neighborhood of such proposed use,
evidenced by the following findings:
1. That the use applied for is in conformance with the
Land Use Element of the Tustin General Plan.
2. The construction proposals are in conformance with
the development standards of the Commercial General
District.
D. That the establishment, maintenance and operation of
the use applied for will not be injurious or detrimental
to the property and improvements in the neighborhood of
the subject project, nor to the general welfare of the
city of Tustin, and should be granted.
E. Proposed development shall be in accordance with the
development policies adopted by the City Council;
Uniform Building Codes as administered by the Building
Official; Fire Code as administered by the Orange County
Fire Marshal; and street improvement requirements as
administered by the City Engineer.
F. That this project is categorically exempt from the
requirements of the Cali'fornia Environmental Quality
Act.
G. Final development plans shall require the review and
approval of the Community Development Director.

II.
The Planning Agency hereby approves Use Permit No. 82-21
to authorize the construction and operation of a
drive-up service window at an existing fast food
restaurant located at 14232 Newoprt Avenue subject to
the following conditions:
A. Approval of Zone Change 82-2 by the City Council
authorizing Commercial General District regulations for
the subject property
B. The final site plan shall be standardized and reflect
all appropriate City standard drawing numbers. The
developer shall construct all missing or damaged street
improvements to said development per the City of Tustin
"Minimum Design Standards of Public Works" and "Street
Improvement Standards". This work shall consist of, but
is not limited to: curbs and gutters, sidewalks, drive
apron, street pavement and street trees.
C. Installation of marbelite street lights with
underground conduit. Submit three prints to Southern
California Edison Company for light layout.
D. A striped pedestrian lane shall be provided across
the drive-thru lane from the parking area to the north
side public entrance.
E. Additional signing shall be limited to the following:
1. One (1), six (6) square foot on-site direction
sign per driveway entrance, four (4) foot maximum
height (three total).
2. One twelve (12) square foot drive-up sevice
advertising sign added to the existing pole sign.
The design must be similar to that of the existing
sign.
3. One menu board not to exceed thirty-four (34)
square feet, and two (2) six (6) square foot
directional signs on the interior of the site.
F. The sound level of the communication board speaker
shall not exceed limits set forth in the Noise Ordinance
No. 828 so as not to disturb residents to the rear of
the project.

G. Planting and irrigation plans shall be submitted to the
Building Division for review and approval.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Agency held on the~day of , 1982.
