ALLEY VACATION AND ABANDONMENT
RECOMMENDATION:
That the Tustin City Council, at their meeting of September 7, 1982, adopt the
attached resolution declaring the City's intention to vacate and abandon a portion
of the alley between E1 Camino Real and "C" Street northerly of Second St. and to
fix a'time and place of public hearing thereon.
BACKGROUND:
The attached resolution is a declaration of intention to vacate and abandon a
portionof an alley between E1Camino Real and "C" Street and northerly of Second
Street, and to fix a time and place of public hearing thereon
That portion of alley to be vacated and abandoned is described and delineated on
Exhibit "A".
The request for this alley abandonment comes from two individuals as indicated on
the attached letter, so that the proposed office building development for 175 "C"
Street can proceed as outlined in Variance No. 82-9. This alley presently
contains a sanitary sewer facility which also will require abandonment. However,
prior to abandonment of this sewer, provisions must be made by the property owner
of 170 E1 Camino Real to provide sewer connection to that parcel via a sewer other
than the facility located within the alley; i.e. the sanitary sewer within E1
Camino Real. Any connection to the sewer within E1 Camino Real should be made
prior to or concurrently with the street reconstruction presently underway.
Records indicate there are no other utility easements located within the alley.
On September 7, 1982, the Planning Agency will be requested to adopt a resolution
recommending to the City Council the disposition of this portion of the alley
right-o-way.
The following is the anticipated scheduling for the proposed vacation and
abandonment:
September 7, 1982 - Adopt resolution to declare the City's intention to
vacate and
September 16, 1982 - Publish in Tustin'News the notice of proposed hearing.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, DECLARING ITS INTENTION TO VACATE AND
ABANDON A FORTION OF AN ALLEY BETWEEN EL CAMINO REAL
AND "C" STREET AND NORTHERLY OF SECOND STREET AND TO
FIX A TIME AND PLACE OF PUBLIC HEARING THEREON.
WHEREAS, the initial construction of a portion of said alley was
for access to parcels of land known as 175 "C" Street and 170 E1Camino Real;
and
WHEREAS, said proposed office developnmnt located at 175 "C" Street
and 170 E1Camino Real will not require access from said alley;
NOW, THEREFORE, the City Council of the City of Tustin, California,
does hereby resolve as follows:
It is the intention of the City Council to vacate that portion
of an alley between E1Camino Real and "C" Street and northerly
of Second Street shown on Exhibit "A" attached hereto and
incorporated herein by this reference, and on file in the
office of the City Clerk.
2. A finding that the alley is unnecessary for present or
prospective street purposes.
3. Reservation of easements per Section 8330 of the Street and
Highway Code.
4. Categorical exemption from EIR requirements.
A public hearing is hereby set for October ¢, 1982, at 7:30
p.m., in the Chambers of the City Council at 300 Centennial
Way, Tustin, California, for hearing all persons interested in
or objecting to the proposed vacation.
This resolution shall be published once in the Tustin News, a
newspaper of general circulation published in the City of
Tustin, not less than fifteen (15) days before said hearing,
and notice of said hearing shall be posted conspicuously along
the line of the portion of said alley proposed to be vacated
not less than ten (10) days before said hearing, not more than
three hundred feet (300') apart, and not less than three (3)
copies shall be posted.
The City Council elects to proceed under the provisions of
Chapter 2, Part 3, Division 9 (Sections 8320 et seq.) of the
California Streets and Highways Code.

Those portions of Lots 3 and 18, Book 4, of the Tustin City tract
as shown on a map recorded in Book 4, Page 218, Miscellaneous
Records of Los Angeles County, California, described as follows:
The westerly 10.00 feet of Lot 3, Block 4, of said Tustin City
Tract and the easterly 10.00 feet of Lot 18, Block 4, of said
Tustin City tract.
