Property runs southerly from Main on "B" for 366 feet and southerly from Main on "C" for 304 feet To change the zone designation from Multiple Family Residential (R-3) to Professional Office (PR) District RECOI~I4ENDED ACTION If the Planning Agency recommended approval for the Zone change, the following actions are in order: M.O. - Ordinance No. 876 have its first reading by title only M.O. - Ordinance No. 876 be introduced BACKGROUND By various actions that date back to early 1980, the Planning Agency and City Council have given approval for the office development on the subject properties known as Stevens Square. One of those approved actions involved a General Plan Amendment that changed the classification for the project area rom Multiple-Family to Professional Office. The zone change before the Council is the implementing zoning required to bring the property into conformance with the General Plan. DISCU~ION As originally proposed, Gfeller Development requested authoriztion for a professional office complex to be constructed around the Stevens House at 22B W. Main. At that time, the General Plan designation was Multiple-Family and the zoning was R-3. As such, professional offices were permitted subject to a conditional use permit; however, it was felt that with a project the size of Stevens Square, both the General Plan and subsequent zoning should more accurately reflect the use of the property. Since the General Plan has al ready been amended, and the office project is virtually complete, Zone Change 82-3 is basically a house keeping item that will have no impact on the subject property or any of the neighboring properties. If the Planning Agency recommended approval, it would be appropriate for the Council to favorably consider Zone Change 82-3. ~ JSD:jh j 6-~J-o~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 876 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, APPROVING THE RE-ZONING OF THE PROPERTY LOCATED ON THE SOUTH SIDE OF MAIN STREET BETWEEN "B" AND "C" STREETS SOUTHERLY FROM MAIN ON "B" FOR 366 FEET AND SOUTHERLY FROM MAIN ON "C" FOR 304 FEET, FROM THE MULTIPLE-FAMILY RESIDENTIAL (R-3) DISTRICT TO THE PROFESSIONAL OFFICE (PR) DISTRICT The City Council of the City of Tustin does hereby ordain as follows: I. The City Council finds and determines as follows: A. That a proper application, (Zone Change 82-3), has been filed by the City of Tustin, for a zone change from Multiple-Family Residential (R-3) District to Professional Office (PR) District for the property located~on the south side of Main Street between "B" and "C" Streets, southerly from Main on "B" for 366 feet and southerly from Main on "C" for 304 feet. B. That a public hearing was duly called, noticed and held on said application. C. That a zone change should be granted for the follow- ing reasons: That the Tustin Area General Plan currently designates the subject property as Professional Office. That in order to bring the subject property into conformance with the General Plan, a zone change to a Professional Office is required. That since the development on the property is currently nearing completion and is subject to all conditions of approval of Conditional Use Permit 80-1, Zone Change 82-3 will not have any adverse impacts on the surrounding properties. D. Development of subject property shall be in accordance with the policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 Ordinance No. 876 Page 2 E. Final development plans shall require the review and approval of the Community Development Director. F. That a Negative Declaration was previously approved to comply with the requirements of the California Environmental Quality Act. II. The City Council hereby approves Zone Change 82-3 for the above described properties from Multiple-Family Residential (R-3) District to Professional Office (PR) District.
