RECOI~I~NDED ACTION
If the Agency recommended approval, the following actions are recommended:
M.O. Ordinance No. 877 have first reading by title only;
M.O. Ordinance No. 877 be introduced.
BACKGROUND
The following is a summary of past actions taken on the subject properties:
1. June, 1979 - properties annexed into the City of Tustin, pre-zoned R-3
(Annexation No. 120). General Plan classification was Multiple-Family;
2. June 7, 1982 - General Plan Amendment 82-1(A) approved changing General
Plan from Multiple-Family to Commercial;
3. September 7, 1982 - Subject Zone Change scheduled for public hearing
before the Planning Agency at 3:00 p.m. meeting.
DISCUSSION
As was outlined in the staff report to the Planning Agency, it is felt that
the CG-PUD zone is the most appropriate classification for these specific
properties. If the Agency, at the afternoon meeting recommended approval
of Zone Change 82-4, then it would be appropriate for the City Council to
consider the zone change.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, APPROVING THE RE-ZONING
OF THE PROPERTIES LOCATED AT 17311 AND
17341 MCFADDEN STREET FROM MULTIPLE-FAMILY
RESIDENTIAL (R-3) DISTRICT TO COMMERCIAL
GENERAL-PLANNED UNIT DEVELOPMENT (CG-PUD)
DISTRICT
The City Council of the City of Tustin does hereby ordain as
follows:
I. The City Council finds and determines as follows:
A. That a proper application, (Zone Change 82-4), has
been filed by the City of Tustin, for a zone change from
Multiple-Family Residential (R-3) District to Commercial
General-Planned Unit Development (CG-PUD) District for
the property described in Exhibit "A" attached hereto
and incorporated herein by this reference as though set
forth herein in full.
B. That a public hearing was duly called, noticed and
held on said application.
C. That a zone change should be granted for the follow-
ing reasons:
The Commercial General District is in conformance
with the commerical land use designation of Tustin
Area General Plan.

The Commercial General District authorizes a broader
range of permitted uses and provides the opportunity
for review of unclassified uses for appropriateness
of site and development.
D. Development of subject property shall be in
accordance with the policies adopted by the City
Council; Uniform Building Codes as administered by the
Building Official; Fire Code as administered by the
Orange County Fire Marshal; and street improvement
requirements as administered by the City Engineer.
E. Final development plans shall require the review and
approval of the Community Development Director.
F. That a Negative Declaration was previously approved
to comply with the requirements of the California
Environmental Quality Act.
G. Uses within the District are subject to approval of a
Use Permit

II.
The City Council hereby approves Zone Change 82-4 for
the above described properties (Exhibit "A") from
Multiple-Family Residential (R-3) District to Commercial
General-Planned Unit Development (CG-PUD) District.
PASSED AND ADOPTED at a regular meeting of the City Council held on
the day of , 1982.
