Chudzinski 305 W. First Street (Commercial General-Planned Unit Development) Authorization to construct a 2,900 square foot retail/wholesale book store in the Commercial General {Planned Unit Development) District BACICGROUND & DISCUSSION The subject property was the site of the old Van Hove automobile repair garage. In May, 1981, the Sathya Sai Baba Society applied for and was granted a Use Permit to convert the existing garage structure into a book store. The Planned Unit Development District of the Commercial General Zone requires use permit approval for all developments. After a detailed inspection of the garage structure, the Society decided to demolish it and construct a new building for its needs. The 2,900 square foot, single stow structure consists of 400 square feet of retail sales, 840 square feet .office area and 1,660 square feet of warehouse space. The architectural style is a contempora~ Spanish type with stucco walls and mission tile roof. There appears to be an error in the lot dimensions. Current assessor records indicate the lot is only 133' in depth. The missing two feet (from 135') can be accommodated within the design and should not create any problems. FII(DINGS & CONCLUSIONS 1. The site design and architectural features satisfy all of the zoning provisions and development standards of the City. 2. A revised site plan, which incorporates the correct lot dimensions, should be submitted with plan check drawings. 3. Any storage of materials in the rear patio area should be screened from view and not contain any hazardous or odorous substances. 4. The construction of the building with its amenities (landscaping, fountain) will add to an improved streetscape. Chairman & Planning Agency Members September 20, 1982 Page 2 5. FIRST STREET PURSUANT TO PLANNED UNIT DEVELOPMENT PROVISIONS OF THE COMMERCIAL GENERAL DISTRICT Agency of the City of Tustin does hereby resolve as I. The Planning Agency finds and determines as follows: A. That a proper application, (Use Permit 82-25), has been filed on behalf of Walter W. Newbauer for the Sathya Sai Baba Society to request authorization to develop a retail/wholesale book store at 305 W. First Street, pursuant to the Commercial General District requirements. B. That a public hearing was duly called, noticed and held on said application. C. That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: The proposed use is in conformance with the Land Use Element of the Tustin Area General Plan and with the provisions of the Commercial General Zoning District. The application is in conformance with the Use Permit requirements of the Planned Unit Development Standards of the district. D. That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject project, nor to the general welfare of the city of Tustin, and should be granted. E. Proposed development shall be in accordance with the development policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. F. This project is categorically exempt from the requirements of the California Environmental Quality Act. G. JO September 20, 1982 Page 2 II. The Planning Agency hereby approves Conditional Use Permit No. 82-25, to authorize construction of a 2,900 square foot retail/wholesale book store at 305 W. First Street subject to the following conditions: A. The final site plan shall be standardized 'and reflect all appropriate City standard drawing numbers. The developer shall construct all missing or damaged street i~rovements to said development per the City of Tustin "Minimum Design Standards of Public Works" and "Street Improvement Standards." This work shall consist of, but is not limited to: curbs and gutters, sidewalks, drive apron, street pavement and street trees. B. A final grading plan shall be submitted to the City for review and approval. C. The driveway shall be constructed to City Standard No. 108B. D. All existing sanitary sewer laterals and domestic water services shall be shown on the final grading or site plan. E. The site plan shall be correced to reflect the following: 1. First Street width of 100' from right-of-way line to right-of-way line. 2. The distance between parkway curb face and median island curb face is 34.5 feet in lieu of 32'-8" and the parkway width is 8'. F. The handicap parking space is to be 14'-0" in width. G.
