(Roll Call Vote) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 ORDINANCE NO. 878 AN ORDINANCE OF THE CIl~f COUNCIL OF THE CITY OF TUSTIN, APPROVING THE RE-ZONING OF CERTAIN PROPERTIES FROM C-1 TO CG DISTRICT AT THE NORTHEASTERLY CORNER OF NEWPORT AVENUE AND MITCHELL AVENUE The City Council of the City of Tustin does hereby ordain as follows: I. The City Council finds and determines as follows: A. That a proper application, (Zone Change 82-2), has been filed by Taco Bell on behalf of Realty Income Proprties, for a zone change from the Retail Commercial (C-1) District to Commercial General (CG) District for the property described in Exhibit "A" attached hereto and incorporated herein by this reference as though set forth herein in full. B. That a public hearing was duly called, noticed and held on said application. C. That a zone change should be granted for the follow- ing reasons: The Commercial General District is in conformance with the commerical land use designation of Tustin Area General Plan. The Commercial General District authorizes a broader range of permitted uses in an area of increasing commerical activity. D. Development of subject property shall be in accordance with the policies adopted by the City Council; Uniform Building Codes as administered by the Building Officiai; Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. E. Final development plans shall require the review and approval of the Community Development Director. F. The City Council hereby approves Zone Change 82-2 for the above described properties (Exhibit "A") from Retail Commercial (C-1) District to Commercial General (CG) District.
