Approve Use Permit 82-28 by the adoption of Resolution No. 2064.
BACKGROUND
The proposed arcade will be located in the north east section of Larwin
Square, in a portion of a suite formerly occupied by a paint store. In the
original proposal, the suite was to be divided into two sections, with the
arcade occupying one suite and a pizza restaurant in the other.
Staff has now received information from the applicant that the arcade will
no longer be in a separate suite, but combined with the restaurant, which
is known as "Heaps of Pizza" and operated by R.L. Kaufmann and Company,
Inc.
The original proposal will remain the same, with a request to operate
thirty (30) video arcade games in the same location in the suite. The
lease will be held by R.L. Kaufmann and Company and the games will be
operated and maintained by the applicant.
DISCUSSION
In evaluating the proposal, the June 7, 1982 memo to the Council regarding
arcade review and guidelines was utilized.
The proposed arcade is located in a multi-tenant commercial center that is
adequate in size to provide for secondary supervision. The arcade is
adequately separated from schools, parks, churches, hospitals, and
residential uses. The nearest residence is approximately 1,000 feet away.
The nearest school is Columbus Tustin.

The original proposal called for the arcade as the primary business
entity. Although the arcade will still be operated by the applicant, it
has been combined with the adjacent pizza restaurant to form a single
business entity. The total square footage will be 4,300 square feet, of
which 1,200 square feet will be devoted to the 30 games. By comparison,
Lamppost Pizza has 3,657 sq. ft. (147 sq. ft. for 10 games), Sgt.
Pepperoni's has 4,043 sq. ft. (105 sq. ft. for 9 games) and Ski Fever has
2,100 sq. ft. (600 sq. ft. for 20 games). Given these figures, previously
approved arcades seem to be less intense than the proposal with the
exception of Ski Fever, which is more intense.
Additional conditions should require that bike racks be included and
located on site so as not to obstruct any vehicular or pedestrian traffic,
and that the addition of any machines over the requested 30 shall be
subject to Planning Agency review and approval.

RESOLUTION NO. 2064
A RESOLUTION OF THE PLANNING AGENCY OF THE
CITY OF TUSTIN, GRANTING AUTHORIZATION TO
OPERATE AND MAINTAIN A VIDEO ARCADE AT
618 E. FRIST STREET
Agency of the City of Tustin does hereby resolve as
I. The Planning Agency finds and determines as follows:
A. That a proper application, (Use Permit 82-28), has
been filed on behalf of Larwin Square Limited by Frank
Ohlgren requesting authorization to operate video arcade
games at 618 E. First Street.
B. That a public hearing was duly called, noticed and
held on said application.
C. That establishment, maintenance and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals,
comfort or general welfare of the persons residing or
working in the neighborhood of such proposed use,
evidenced by the following findings:
1. The proposed use is in conformance with the Tustin
Area General Plan.
2. The proposed use is in conformance with the City of
Tustin Zoning Ordinance, as amended.
3. The proposed use, as approved, conforms with the
intent of the guidelines for review of game arcades.
D. That the establishment, maintenance and operation of
the use applied for will not be injurious or detrimental
to the property and improvements in the neighborhood of
the subject project, nor to the general welfare of the
city of Tustin, and should be granted.
E. Proposed development shall be in accordance with the
development policies adopted by the City Council;
Uniform Building Codes as administered by the Building
Official; Fire Code as administered by the Orange County
Fire Marshal; and street improvement requirements as
administered by the City Engineer.
F. This project is categorically exempt from the
requirements of the California Environmental Quality
Act.
G. Final development plans shall require the review and
approval of the Community Development Director.

II.
The Planning Agency hereby approves Conditional Use
Permit No. 82-28, to authorize the operation and
maintenance of video arcade games at 618 E. First Street
subject to the following conditions:
A. The arcade portion of the establishment will be under
constant supervision by the management of the pizza
restaurant.
B. The number of video games shall be limited to thirty
(30). Any increase in the number of video games will
require an amendment to the use permit.
C. Prior to the opening of the arcade, a bike rack
layout shall be submitted for review and approval to the
Community Development Department.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Agency held on the~day of , 1982.
