RECOMMENDED ACTION
Adoption of Resolution No. 82-72, scheduling a protest hearing for 3:00
p.m., October 4, 1982 for the proposed Irvine -Elizabeth Way Annexation No.
130.
BACKGROUND
The City Council, at the request of the Aldersgate United Methodist Church,
submitted an annexation proposal to the Local Agency Formation Commission
for the 7.84 acre area easterly of Elizabeth Way.
The Local Agency Formation Commission conducted a public hearing on August
25, 1982 for the proposed annexation. Three property owners on the
easterly side of Elizabeth Way requested, by letter, that their properties
be excluded from the annexation proposal. LAFCO denied this request and
unanimously approved the annexation proposal. No one spoke in opposition
to the annexation at the LAFCO hearing.

RECON~NDED ACTION:
Conduct protest hearing and accept written protests from property owners
within the subject annexation area.
Make a finding as to the value of written protests received prior to the
close of the public hearing.
Adopt Resolution No. 82- ~1 approving the Irvine-~lizabeth Way Annexation
No. 150.
BACKGROUND:
Th, e proposed annexation was initiated by City Council Resolution No. 82-59 on
July 19, 1982 at the request of the Aldersgate United Methodist Church.
The Local Agency Formation Con~nission conducted a public hearing on .August 2S,
1982 and unanimously approved the annexation proposal. No protests were filed
at the LAFCO hearing. Three property owners on Elizabeth Way requested LAFCO
to delete their properties from the annexation. LAFCO denied their request and
determined that the annexation was a logical extension of the City of Tustin
boundaries.
The City Council adopted Resolution No. 82-72 on September I, 1982 scheduling
a protest hearing at 3:00 p.m. on October 4, 1982. Notice was given to all
property owners within the annexation area, as well as to adjoining property owners
who desire to be annexed to the City of Tustin. No written protests have been re-
ceived as of the preparation of this report.
The total value of the area proposed for annexation is $1,209,618. If protests
are received from property owners who own property valued at less than 50%
($604,809) of the total, the Council is required to approve the annexation proposal.
(The Aldersgate ~thodist Church and County Fire Station represent more than
50% of the total value within the annexation territory.)

RESOLUTION NO. 82-81
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, DETERMINING THE VALUE OF
WRITTEN PROTESTS AND ORDERING THE ANNEXATION
OF UNINHABITED TERRITORY KNOWN AS "IRVINE-
ELIZABETH WAY ANNEXATION NO. 130" TO THE
CITY OF TUSTIN.
The City Council of the City of Tustin does hereby resolve as
follows:

Pursuant to Chapter 2, Part 2, Division 2 of Tit)e 4 of the
Government Code, preliminary proceedings were completed by the Local
Agency Formation Commission on August 25, 1982 and the City of
Tustin was designated as the conducting authority and authorized to
~roceed with the annexation of the territory designated as
Irvine-Elizabeth Way Annexation No. 130".
The City Council, pursuant to Section 35201 of the Government Code,
adopted Resolution No. 82-72, initiating annexation proceedings and
fixing a time and place for a protest hearing.
Due notice was given and a protest hearing was conducted after 3:00
p.m. October 4, 1982 and protest from property owners
representing % of the ~otal assessed value of the area proposed
for annexation' was received prior to the close of the hearing.
Pursuant to Section 35337 of the Government Code, the City Council
finds that the value of written protests is % of the total
assessed value of land and improvements with~he area and.
represents less than 50 percent of the total assessed value of land
and improvements within the territory.
The City Council hereby orders the annexation to the City of Tustin
of the uninhabited territory designated "Irvine-Elizabeth Way
Annexation No. 130" as specifically described in the legal
description and map attached hereto as Exhibit "A".
Satisfaction of the requirements of Section 99(d) of the Revenue and
Taxation Code has been accomplished by City Council Resolution No.
80-119 and Board of Supervisor's Resolution No. 80-1903 accepting a
Master Property Tax Transfer Agreement applicable to subject fully
developed area.
Subject annexation shall be effective upon the filing and recording
of the certificate of completion by the Executive Officer of the
Local Agency Formation Commission.
The City Clerk shall transmit a certified copy of this Resolution,
along with the required fees payable to the State Board of
Equalization, to the Executive Officer of the Local Agency Formation
Commission for certification of completion and recording.

TO THE CITY OF TUSTIN, CALIFORNIA
That portion of Lot 331, Block 13 and Lot 2, Block 12 of Irvine's
subdivision in unincorporated territory of the County of Orange, State of
California as per map recorded in Book 1, Page 88 of Miscellaneous Maps,
records of said Orange County, described as follows:
PARCEL 1
Beginning at a point on the existing centerline of Irvine Boulevard,
referred to as Point "A" for the purpose of this description, said point
being an angle point in the existing City of Tustin boundary as
established by.the Red Hill Center Annexation and also being distant along
said centerline S.49°57'40"E., 1320.93 feet from the most westerly corner
of said Block
Thence, along the existing City of Tustin boundary per above-mentioned Red
Hill Center Annexation, and the Irvine-Elizabeth Annexation No. 76 through
the following courses;
N.49°57'40"W., 330.51 feet; Thence,
N.39°56'51"E., 301.94 feet; Thence,
N.49°57'40"W., 165.00 feet; Thence,
N.39°56'51"E., 66.00 feet to an angle
point in said City of Tustin boundary;

along the southeasterly line of the northwesterly 1/2 of the northwesterly
1/2 of the southerly 1/4 of said Lot 331, as shown on a parcel map filed
