Since the site has no previous use permit approval, and this proposal constitutes a complete reconstruction of the station, a use permit was required. The proposed reconstruction was reviewed utilizing the Service Station Development Guidelines. DISCUSSION As proposed, the site plan substantially conforms to the service station guidelines. Because of site constraints, the service station was unable to design the service bays facing away from the street, but site and architectural improvements will enhance the appearance of the area. The proposal also includes a change to the existing pole sign, which was approved in 1971 for a total of forty-seven (47) square feet per face, with a maximum height of twenty-five (25) feet. The new sign will be a maximum height of eighteen (18) feet, with a total of twenty-seven (27) square feet per face. A price sign of 46"x72-1/2" will be included. This proposed pole sign is in substantial conformance with sign code guidelines for service stations. RECOI~I~NDED RCTION Approval of Use Permit 82-29 by the adoption of Resolution No. 2065. EMK:jh 1 2 3 4 5 6 7 8 9 lO 11 12 13 14 15 16 17 18 19 2o 21 22 23 24 25 26 27 RESOLUTION NO. 2065 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, AUTHORIZING THE RECONSTRUCTION OF A SERVICE STATION AT 13052 NEWPORT AVENUE The Planning Agency of the City of Tustin does hereby resolve as follows: I. The Planning Agency finds and determines as follows:. A. That a proper application, (Use Permit 82-29), has been filed by Tait & Associates on behalf of Chevron U.S.A., Inc. to reconstruct and revitalize a service station at 13052 Newport Avenue. B. That a public hearing was duly called, noticed and held on said application. C. That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The proposed use is in conformance with the Tustin Area General Plan. 2. The proposed use is in conformance with the City of Tustin Zoning Ordinance, as amended. D. That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject project, nor to the general welfare of the city of Tustin, and should be granted. E. Proposed development shall be in accordance with the development policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. F. This project is categorically exempt from the requirements of the California Environmental Quality Act. G. The Planning Agency hereby approves Conditional Use Permit No. 82-29, to authorize the reconstruction of a service station at 13052 Newport Avenue subject to the following conditions: A. The final site plan shall be standardized and reflect all appropriate City standard drawing numbers. The developer shall construct all missing or damaged street improvements to said development per the City of Tustin "Minimum Design Standards of Public Works" and "Street Improvement Standards". This work shall consist of, but is not limited to: curbs and gutters, sidewalks, drive apron, and street pavement. B. A final landscape plan is required for review and approval by the Community Development Department. C. A new sign is approved that shall not exceed eighteen (18) feet in height, or a total of twenty-seven (27) square feet per face, double faced. D. A permanent gasoline pricing sign shall be installed that is in conformance with state guidelines for mandatory gasoline price signs. E. Any other sign modifications shall be in conformance with Sign Code No. 684, as amended. F. Exterior colors and materials shall be reviewed and approved by the Community Development Department.
