HomeMy WebLinkAboutOB 1 DENIAL ZONING REQ 10-20-82 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 OLD BUSINESS NO. 1 RESOLUTION NO. 2061 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, DENYING A REQUEST TO VARY WITH THE ZONING REGULATIONS OF THE RETAIL COMMERICAL DISTRICT BY CONSTRUCTING AN OFFICE STRUCTURE ON A SUBSTANDARD PARCEL OF LAND The Planning Agency of the City of Tusttn does hereby resolve as follows: I. The Planning Agency finds and determines as follows: A. That a proper application, (Variance No. 82-10), was filed by Phillip B. Schindler, requesting authorization to vary with the requirements of the Retail Commercial District (City Code Section 9232(c)) and the Public Improvement provisions of the Zoning Code General Regulations (Section 9271x) to construct a 1798-1/2 square foot office building at 15601 Newport Avenue. B. That a public hearing was duly called, noticed and held on said application. C. That because there are no special circumstances applicable to the subject property, relative to size, shape, topography, location or surroundings, and approval of this application would grant the subject project privileges not enjoyed by other properties in the vicinity and under identical zone classification, evidenced by the following findings: 1. With the change of ownership, the present owner was informed by the previous owner of the property that no present or future development rights were guaranteed and thus the hardship was self-imposed. 2. The ownership of the property has changed since the Zoning Ordinance provisions were in effect and therefore no hardship has been placed upon the current property owner since its purchase. O. That the granting of a Variance as herein provided would be contrary to the intent of the Zoning Ordinance or the public safety, health and welfare, and said Variance should not be granted. II. Planning Agency hereby denies Variance 82-10 as applied for. PASSED AND ADOPTED at a regular meeting of the Planning Agency of the City of Tustin, California, held on the 20th day of October, 1982.
