Parking Lot Sales
DISCUSSION
Recently, this department has received several inquiries concerning
authorization for parking lot-type sales which are unrelated to the
business at the proposed location. Items for sale have included clothing,
tools, sport equipment, china and tricycles. Pursuant to various sections
of the City Code, a temporary use permit may be issued for up to thirty
(30) days by the Community Development Department for outside sales in the
C-2 and CG districts. A proliferation of such uses could tend to give a
flea market or swap meet impression to such locations, especially on
weekends. Staff is of the opinion that perhaps such permits should not be
issued indiscriminately and, if desired, there should be an Agency policy
towards temporary outdoor sales.
RECOI~NDED ACTZON
It is recommended that the Planning Agency adopt the following items as a
matter of policy for regulating temporary outdoor sales.
Temporary outdoor sales be limited to one sale per calendar quarter for
each location.
2. Sales to be limited to three days in duration, and only on weekends.
That vendors (not having an established place of business on site), be
limite--~to one sale per month, twelve use permits per year. This would
eliminate the possibility of a sale moving from corner to corner every
weekend of the year.
None of the above would restrict a center or property owner from
obtaining a temporary use permit for outdoor sales in conjunction with
center or business operations (i.e., a tire sale for a service station
or a merchants association function within their center. The provisions
are only applicable to transitory operators.
5. That temporary outdoor sales be allowed in all commercial zones, not
just C-2 and CG (excluding professional office).
6. Any deviation from the above guidelines will require approval of the
Zoning Administrator.
