HomeMy WebLinkAboutOB 1a USE PERMIT 82-12 11-01-82DATE: November 1, 1982 OLD BUSINESS NO. 1 Inter-Corn TO: FROM: SUBJECT: Honorable Chairman & Planning Agency Members Co~nunity Development Department Use Permit 82-12 BACKGROUND Use Permit 82-12 was a request to operate a video arcade at 17292 McFadden, Suite K. The applicant is Edward Starnes, who owns and operates a ski store called Ski Fever. The permit was approved June 21, 1982, by the adoption of Resolution No. 2038. Condition II C limited the number of machines to twenty (20) for a minimum of ninety days after the approval. After this period of time, the Planning Agency could grant an additional six machines, bringing the total to twenty-six (26). This review period has expired and the applicant is requesting that the Planning Agency authorize the addition of ten (10) machines, bringing the total to thirty (30). DISCUSSION Staff has received no complaints concerning the operation of the arcade from either the surrounding residential areas or the adjacent businesses. With regard to the request for thirty (30) machines, the City Attorney has advised staff that the Resolution of approval gave a specific number of games and only that number can be authorized without filing a new public hearing. Mr. Starnes would have to refile and another public hearing would have to be held to authorize the addition of more machines. The applicant has been advised that a refiling of the use permit and a new public hearing would have to be held in order to authorize additional video games over twenty-six (26). RECO~4~NDED ACTION Staff recorm~ends the Planning Agency grant the addition of six (6) video games at 17292 McFadden, Suite K by Minute Order. Referring to resolution no. 2038, no. II C it states that my number of games shall be limited to 20, and after 90 days of operation authorization of up to 26 games could be granted by the planning agency. I am requesting that you grant this authorization, but increase the number from 26 to 50 games. My request is based on the fact that two other video arcades in the City of Tustin have been allowed $0 games. The two arcades are Tustin Lanes and the new pizza parlor in Larwin Square.
