PARK IMPROVEMENTS REQUEST FOR TIME EXTENSION RECOMMENDATION: It is recommended that the City Council, at their meeting of November 1, 1982, grant a one day time extension to ACME Pipeline and Engineering in connection with subject project, and establish the completion date for the project to be Oct. 19, 1982 and authorize staff to assess a $100.00 per day penalty for every day thereafter until project is completed to the satisfaction, of staff. BACKGROUND: Attached is a letter from ACME Pipeliqe and Engineering requesting a one week time extension. The letter outlines five reasons for their request. The contract allowed 45 calendar days to complete the project. Effective October 18, 1982, the 45 calendar day completion time has expired and the contractor has been informed that he is working under the $100.00 per day penalty as provided for in the specifications. Staff feels that only one of the five items outlined in the contractor's letter is a valid reason for an additional time extension as outlined below: ITEM NO. I - In calculating the Oct. 18 completion date, 3 additional days were allowed due to this delay. ITEM NO. 2 - This is not true - the ground was not unstable. ITEM NO. 3 - It is our understanding that the water lines were broken by the contractor. ITEM NO. 4 - We feel this is valid for a one day time extension extending the completion date to Oct. 19, 1982. ITEM NO. 5 - It is the contractor's responsibility to protect the work and his equipment. This is not a valid reason for a time extension. This is one of the few times that we have found it necessary to recommend enforcement of the penalty clause in a contract. In this case, we feel it is F.Y. 1981-82 MISC. Which required location time. Unstable ground conditions found at basketball court. Which required special attention for compaction work. Waterlines broken due to vandalism, caused flood which required extra time for ground to dry. Obstruction with electrical system encountered during trenching. Delayed work schedule. Various vandalism happenings such as cutting ignition wires to equipment and trucks. Foot prints in concrete walkway and curbs. Van- dalism to drink fountain and distruction of parts which are due to arrive in six weeks. Ail of these unexpected actions have contributed to the delay of our original completeion plans.
