HomeMy WebLinkAboutCC 6 SOLID WASTE AG 11-01-82A GENDA DATE OCTOBER 26, 1982 Inter-Corn TO: FROM: SUBJECT: WILLIAM HUSTON, CITY MANAGER BOB LEDENDECKER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SOLID WASTE COLLECTION AGREEMENT RECOMMENDATION: That the Tustin City Council, at their meeting of November 1, 1982, authorize the Mayor to execute the amendment to the Solid Waste Collection Agreement for an adjustment of rates. BACKGROUND: At their meeting of October 20, 1982, the City Council approved the requested rate increase by S.C.A. Services of Orange County for refuse pickup due to the recent Landfill Gate Fees imposed by the County of Orange and authorized the City Attorney to prepare an amended Solid Waste Collection Agreement. DISCUSSION: The attached amendment to the Solid Waste Collection Agreement has been prepared by the City Attorney's office and contains all of the rate increases as approved by City Council on October 20, 1982. This amended agreement will remain in effect until June 30, 1983, the original date of termination for the Solid Waste Collection Agreement. BOB LEDENDECKER DIRECTOR OF PUBLIC WORKS/ CITY ENGINEER db Attachment AMENDMENT TO AGREEMENT THIS AGREEMENT is made and entered into this day of , 1982, by and between the CITY OF TUSTIN, a municipal corporation (hereinafter "City") and SCA SERVICES OF ORANGE COUNTY, a California corporation (here- inafter "SCA"). WI TNE S SETH WHEREAS, City and Holthe Disposal Service entered into that certain Solid Waste Collection Agreement dated May 5, 1972, pursuant to which Holthe Disposal Service agreed to and did provide solid waste collection service within the City of Tustin, and WHEREAS, City, Holthe Disposal Service and Great Western Reclamation, Inc., a California corporation, entered into that certain agreement!entitled "Assumption of Responsi- bilities and Consent to Assignment" dated May 3, 1977, which extended the term of the Solid Waste Collection Agreement dated May 5, 1972, to June 30, i983, and provided that Great Western Reclamation, Inc., a California corporation, assumed the duties, obligations and performances provided in the Solid Waste Collec- tion Agreement dated May 5, 1973, and ~EREAS, Consent to Name Change and Amendment of Contract dated April 20, 1981, was entered into by and between City, Great Western Reclamation, Inc., a California corporation, and SCA, whereby SCA assumed the responsibilities for performance of the obligations of the Solid Waste Collection Agreement dated May 5, 1972, as amended by the Assumption of Responsibilities and Consent to Assignment dated May 3, 1977, and WHEREAS, the County 0f Orange has as of October 11, 1982, instituted gate fees at County landfill sites and transfer stations in the amounts of 154.90 per ton and $8.50 per ton, respectively, with the per ton charges based upon the size of trucks utilized by refuse haulers until such time as scales may be installed and ~ WHEREAS, SCA has requested a rate adjustment to accommo- date the said gate fees and WHEREAS, it is has been determined by the City that it is reasonable and in the best interests of the City and its resi- dents that the charges for solid waste collection be increased accordingly. NOW, THEREFORE, inconsideration of the mutual covenants, agreements and considerations herein contained, City and SCA hereby agree as follows: 1. The hereinabove described Solid Waste Collection Agreement dated May 5, 1972, as amended by the aforesaid Assumption of Responsibilities and Consent to Assignment dated May 3, 1977, and the Consent to Name Change and Amendment of Contract dated April 20, 1981, is hereby amended as follows hereafter. 2. The residential rate for solid waste collection, namely for single-family and three (3) or less multi-family units, with non-bin regular service once weekly at curb or alley with materials stored in approved containers or manner, collection limited to 200 pound of solid waste per week with charges paid by City to SCA shall be: $3.65 per month per dwelling unit served 3. Commercial and other non-bin service, services to premises other than those covered by paragraph 2 above, to wit, basic non-bin service once weekly at curb and alley, materials stored in approved containers or manner, one business or build- ing representing one building unit and collection limited to 200 pounds of solid waste per week at one collection point only, charges to be paid by City to SCA, shall be $4.14 per month per building unit. 4. Bin schedule, with full service, lids, wheels, normal rollouts, normal cleaning and maintenance, fees shall be as follows: COMMERCIAL RATE BIN SIZE (Cu. Yd.) Special haul services, collection requested by occupants or owners of bulky material, large items requiring special handling and pick-up at times other than normally scheduled: a. For solid waste contained and approved containers, containers provided by SCA or bundles at approved locations: (1) Up to three cubic yards Unit Price Per cubic yard (charges to be paid by customer to and collected by SCA) $ 10.00 (2) In excess of 3 cubic yards Per cubic yard (charges to be paid by customer to and collected by SCA) $ 5.00 b. For items requiring special handling due to size, weight, type of material, or method of placement, charges shall be agreed upon between customer and SCA prior to collection. If agreement cannot be reached, either party may.request that City prescribe the rate, which City agrees to determine by exercising its discretion in a reasonable manner. The fee fixed by City shall be binding. Charges shall be paid by customer to and collected by SCA. 6. Extended service required by customers in addition to services specifically prescribed herein, with the frequencies and locations as may be agreed upon by SCA and customer, with materials stored in approved containers and manner, with charges to be. paid by the customers to and collected by SCA, shall be at rates agreed upon between customer and SCA. In the event that any such additional service requested by customer for which the customer and SCA do not agree, either party may request that City prescribe the rate, which City agrees to determine exercising its discretion in a reasonable manner. The fee fixed by City shall be binding. 7. Ail charges paid by customers to and collected by SCA shall be subject to a franchise fee of two percent (2%) of the gross receipts to be paid by SCA to City. 8. The Agreement between the parties as amended by this Addendum to Agreement shall remain in force and effect to June 30, 1983. 9. Except as otherwise expressly agreed herein, each and all of aforesaid agreements between the parties and their predecessors in interest shall remain in full force and effect during the term of this Agreement, as amended. -3- IN WITNESS WHEREOF, the parties hereto have executed this Amendment to Agreement on the day and year first above written.
