FLEAGLE, D.P.A. ~tg(~ SUBJECT: NEWPORT-WASS STREET ANNEXATION NO. 132 RECOMMENDED ACTION: Adoption of Resolution No. 82-84 commencing annexation proceedings for the Elizabeth Street-Wass territory on behalf of the residents. BACKGROUND: The properties on the easterly side of Elizabeth Way were approved for annexation to the City of Tustin on October 4, 1982. 'At that time, residents on the westerly side of Elizabeth Way requested that their properties be annexed to the City. The Council directed staff to provide assistance to the residents in initiating an annexation proposal for the area southerly of Wass Street and westerly of Elizabeth Way. Residents of the area circulated a petition among the registered voters within the territory, which was signed by all except One of the eligible voters, indicating their desire to be residents of the City and to vote for the annexation if an election is necessary. The subject area will be processed as an inhabited annexation for the purpose of squaring the boundaries of the City and providing municipal services to the residents of the area. If a majority 'property owner protest is not filed, the area may be annexed without the necessity for an election. Overwhelming sUpport for the annexation proposal is assured by the petition of the residents of the area. WH: dmt 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 82-84 A RESOLUTION OF THE CITY COUNCIL, CITY OF TUSTIN CALIFORNIA, REQUESTING THE COMMENCEMENT OF PROCEEDINGS FOR THE ANNEXATION OF INHABITED TERRITORY KNOWN AS NEWPORT-WASS STREET ANNEXATION NO. 132 TO THE CITY OF TUSTIN. Whereas, a petition has been received from the majority of the registered voters residing in an area abutting the City of Tustin incorporated limits bounded by Wass Street and Elizabeth Way, requesting that the City Council process an annexation proposal on their behalf; and Whereas, this request is made in the interest of property owners and voters of the area who desire to be more strongly identified with and participate in the affairs of the community of which they are a part; and Whereas, said area is a developed area classified as a Class 19 Categorical Exemption from the requirements of an Environmental Impact Report; and Whereas, a Master Property Tax Transfer Agreement dated October 28, 1980 has been approved by the Board of Supervisors of Orange County and the City Council of the City of Tustin pursuant to Section 99(d) of the Revenue and Taxation Code of the State of California. NOW THEREFORE, be it resolved by the City Council of Tustin, California, that: The Local Agency Formation Commission is hereby petitioned to initiate change of organization proceedings pursuant to Part 2, Chapter 2, Article 1 of the Municipal Organization Act of 1977 as an inhabited annexation of territory containing more than 12 registered voters. o The territory is southerly of Wass Street and westerly of Elizabeth Way adjoining the existing city limits on the south, east and westerly boundaries, as more fully described by the map and legal description attached hereto. The Master Agreement providing for the transfer of property tax revenues, as approved by the Board of Supervisors and the City Council on Novemb~ 18, 1982, shall be applicable to the proposed Elizabeth Way/Wass Street Annexation No. 131 to the City of Tustin ~developed property.
