RECOMMENDATION:
That the City Council, at their meeting of November 1, 1982, deny the request of
Mr. Hitchens for the removal of trees without any required replacement, but
authorize the removal based upon the policy outlined in Case II of the current
City Tree Removal Policy.
BACKGROUND:
Staff has received a recent request (copy attached) from Mr. Robert Hitchens of
1271 Mitchell Ave. to have two parkway trees removed. Prior to this current
request and in July, 1982, Mr. Hitchens also requested these trees be removed.

DISCUSSION:
The current policy for street tree removals was adopted by City Council in July,
1978 and reads as follows:
CASE I - Problem tree causing present or future damage to curbs or sidewalks.
City Removal and replacement with 15 gallon sized tree at City expense
subject to availability of funds.
CASE II - Undesireable tree due to extensive litter or other problems.
City removal at City expense and replacement at full cost to property
owner for labor, tree, and materials.
CASE III - Unapproved tree (not of a problem or undesireable species)
City removal and replacement at full cost to property owner.
Both trees in front of Mr. Hitchens' residence are Southern Magnolias which are on
the City-approved street tree list. These tree removals fall under Case II.

Mr. Hitchens has requested a waiver from Case II and requests that these trees be
removed and that they not be replaced based upon reasons outlined in his attached
letter.

Re: Tree Removals - 1271 Mitchell - File #2695
I have reviewed your response to my original letter regarding the trees
in front of my residence. At this time I would like to request relief
from the Council policy which would require the trees to be replaced
if they are removed.
I feel that the one area between two driveways is much too small for a
tree and a utility pole. I believe that the remainder of parkway area
in front of the residence could better be maintained and be more present-
able without a tree. There are numerous residences on the block that do
not have trees, therefore, the absence of a tree in front of my residence
should not be out of place. I appreciate and share the City's concern
for trees. I have recently planted two trees in my back yard and would
even be willing to place one in my front yard to replace the one in the
parkway.
If the trees do not have to be replaced, I would like to request their
removal.

Dear Mr. Hitchens:
I~ response to your recent request for the removal of two Magnolia trees in front
of your residence at 1271 Mitchell Ave., the following information is offered:
In July, 1978, the City Council adopted the following policy with regards to
~arkway tree removals:
I - Problem tree causing present or future damage to curbs or sidewal~s.
City Removal and replacement with 15 gallon sized tree at City expense
subject to availability of funds.
II - Undesireable tree due to extensive litter or other problems.
City removal at City expense and replacement at full cost to property
owner for labor, tree, and materials.
III - Unapproved tree (not of a problem or undesireable species).
City removal and replacement at full cost to property owner.
An inspection of the two trees in front of your residence reveals the following:
1. Both trees are Southern Magnolias, which are a City approved tree for
parkway planting.
2. Both trees are in need of trimming, which should alleviate your concerns
regarding the badly deformed limbs and the closeness to the ground of
other limbs.
3. All evergreen trees such as the Magnolia will drop leaves at times. The
trees in question appear to be in need of water, which is part of the
cause for abnormal dropping of leaves. Magnolia trees require frequunt,
deep watering.
our request appears to fall under category II above. In the event you desire to
proceed with the removals under these conditions, please notify Hugh West of the
Maintenance Division to coordinate the removals. In the event you desire to
retain these trees, notify Mr. West so that he may schedule the trimmin§ of these
trees.
