Inter-Corn Honorable Mayor & City Council Members Community Development Department Zoning Code Revision for Office Uses BACKGROITND At the October 20, 1982 meeting, members of the Planning Agency voiced concern over the predominance of office development proposals in commercially zoned areas. In an effort to ensure that more commercial projects are encouraged in these areas, the Agency suggested the Planning staff draft a revised regulation for office uses in the commercial districts. The attached Zoning Code amendement would modify the General Regulation section (see attachment). A subsection would be added to the provision which requires use permit approval for specific projects or activities. AGW:jh 10-27-82 TUSTiN CITY CODE ZONING 9270 PART 7 GENERAL REGULATIONS 9270 REGULATIONS Ail regulations in this Chapter pertaining to the districts established in Sections 9213a and b hereof-are subject to the general provisions, conditions and exceptions contained in this Part. (Ord. NO. 157, Sec. 5.1) a Interpretation If any ambiguity arises concerning the appropriate classification of a particu- lar use within the meaning and intent of this Chapter, or with respect to matters of height, area requirements or zone boundaries as set forth herein, the Planning Conm~ission shall ascertain all pertinent facts and by resolution set fcrth its findings and interpretations and thereafter such interpretation shall govern, except if the City Council of Tustin directs the Planning Com- mission to adopt a different interpretation. (Ord. No. 157, Sec. 5.2) b Uses Permitted subject to Use Permit Ail of the uses listed in this Part, and all matters directly related thereto are declared to be uses possessing characteristics of such unique and special form as to make impractical their inclus/on in any class of use set forth in the various districts herein defined, and therefore the authority for and location of the operation of any of the uses designated herein shall be subject to the issuance of a use permit in accordance with the provisions of Section 9291. In addition tot-he criteria for determining whether or not a use permit should be issued as set forth in Section 9293b hereof, the Planning Com~nission shall con- sider the following additional factors to determine that the characteristics of the listed uses will not be unreasonably incompatible with uses permitted in surrounding areas. (Ord. No. 157, Sec. 5.3) (1) Damage or nuisance from noise, smoke, odor, dust or vibration; (2) Hazard from explosion, contamination or fire; ~ (3) Hazard occasioned by unusual volume or character of traffic or the congregating of a large number of people or vehicles. The uses referred to herein are as follows: (a) Airports and landing fields. (b) Establishments or,enterprises involving large assemblages of people or automobiles as follows: (1) Amusement parks and race tracks (2) Recreational facilities, privately operated. (Ord. No. 382, Sec. 1) (c) The mining of natural mineral resources, together with the necessary buildings and appurtenances incident thereto. (d) Removal or deposit of earth other than in connection with excavations or deposits in connection with construction of buildings, roadways, or public or home improvements. (e) Presentation of live entertainment. (Ord. No. 406) 1 2 3 4 5 6 7 8 9 10 11 12. 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 ORDINANCE NO. ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, AMENDING CHAPTER 2 , OF ARTICLE 9 OF THE TUSTIN CITY CODE ~ PERTAINING TO OFFICE DEVELOPMENTS ~ The City Council of the City of Tustin does hereby ordain that the Tustin City Code be amended as follows: I. Tustin City Code Section 9270b shall be amended by the addition of a subsection (f) which reads as follows: "Development projects designed for office uses in the C-l, C-2, C-3, CG, M, PM and PC-Commercial districts."
