FEES VIDEO 11-01-82D~TE: November 1, 1982 REPORTS NO. 3 11 - 1-82 Inter-Corn TO: FROM: SUBJECT: Honorable Mayor & City Council Members Community Development Department Business License Fees for Video Games Below are the results of a survey indicating how other Orange County cities charge business license fees for video game machines. Also attached is the current method by which Tustin charges for such machines. Since there is such a variety of ways to collect fees for game machines, a comparison is shown of how Tustin would assess games and what other cities would charge for a similar operation. Anaheim - Fee based on gross receipts for less than five machines. More than five, fee is based on gross receipts plus $100.00 annual arcade fee. Brea - Fee based on gross receipts. Buena Park - Charges a $20.00 review fee. If more than four machines, a $150.00 annual arcade fee is charged, if use permit is approved. Costa Mesa - Based on gross receipts. Cypress - For three machine or less, $15.00 each. Four or more machines, fee based on gross receipts with a minimum charge of $25.00. Fountain Valley - Based on gross receipts if machines owned by outside vendors ($40.00 per $10,000.00 minimum). If owned by licensee, $10.00 per machine in addition to gross receipts. Fullerton - currently under a moratorium. Garden Grove - Fee is $12.00 per machine. If more than four machines in one location, an additional $60.00 arcade fee is charged. Huntington Beach - Four machines or less, if owned by licensed business, proceeds added to gross receipts. Otherwise, $150.00 yearly for less than four machines, for more than four $150.00 plus $12.00 per machine. Irvine - A $30.00 fee for each location. Mayor & City Council November 1, 1982 Page 2 Lacuna Beach - Less than four machines in an existing business, fee is $40.00. More than four is $672.00 per year plus an $45.00 amusement permit. La Habra - $30.00 per machine plus $35.00 base fee. La Palma - $21.00 per year, per machine. Los Alamitos - $10.00 per machine plus normal business license fee. No more than two machines allowed in any location. Newport Beach - Regular Business License fee plus a "skilled games permit" of $70.50, plus $50.00 per machine per year. Orange - Based on gross receipts plus a $5.00 arcade permit~. Placentia - For three machines or less, $25.00 plus $5.00 amusement permit; three machines or more, $25.00 arcade fee plus $25.00 per machine. San Clemente - Three machines or less, $25.00 for first $5,000.00 in gross receipts, then an additional $1.00 for every $1,000.00 thereafter. More than three machines, an additional $100.00 arcade fee. Seal Beach - Flat fee of $50.00 per machine. Stanton - $40.00 per machine for three or less. More than three machines, $40.00 per machine plus $200.00 arcade fee. Westminster - Based on gross receipts. If licensee does not own machines, fee is $15.00 per machine for first four machines, then add gross receipts fee. Yorba Linda - $15.00 per machine. For all businesses with less than five (5) machines, the proceeds of the machines are to be included in the establishment's gross receipts and the business license fee is charged accordingly. For all businesses that have obtained a use permit for an arcade (five or more machines) in conjunction with another use (i.e., bowling alley, restaurants, etc.), a'license fee for the overall establishment is charged (gross receipts), plus an additional $5.00 per machine. 3. Should an arcade ever be approved as an independent use, then the fee would be $25.00 plus $5.00 for each machine. Vendors who supply machines to businesses in the City, yet retain ownership and receive proceeds from said machines, must obtain a Business License. OSD:jh 10-7-82
