SUBJECT: Request for Tree Removal 14751 Birchwood Place
RECOMMENDATION:
I recommend that the tree be removed as requested and no replacement
tree be planted.
BACKGROUND:
A request for removal of the parkway tree at 14751Birchwood Place
from James R. Demarco was received. (see attachment)
Mr. Demarco complained of birds roosting in the tree making a mess
on his driveway and sidewalk and of possible future damage to
the driveway and sidewalk.
DISCUSSION:
Mr. Demarco'~s removal request is covered under the City tree
replacement policy adopted by the City Council 7-17-78 (see copy)
# 2. Whereby the City would remove at City expense and replacement
at property owner expense.
Mr. Demarco is willing to pay for a replacement, however, a tree
should not be planted in the same place due to the confined area.
The tree is bordered on four sides by driveway, sidewalk, curb
and concrete drain structure that comes from Centennial Park out
to the street. The existing tree has damaged the open storm drain.
Also, due to the configuration of Mr. Demarco's property, there is
no suitable place to plant a parkway tree. On the opposite side
of the driveway is the water meter and sewer.

1. PROBLEM TREES CAUSING PRESENT OR FUTURE DAMAGE TO CURB
AND SIDEWALK. ("A" PRIORITY)
CITY WILL REMOVE AND REPLACE WITH A 15 GALLON TREE AT
CITY EXPENSE IN ACCORDANCE WITH AVAILABLE FUNDS.
(~ UNDESIP~ABLE TREE DUE TO EXTENSIVE LITTER OR OTHER PROBLEMS.
("B" PRIORITY)
CITY WILL REMOVE AT CITY EXPENSE AND REPLAEMENT COST OF THE
TREE WOULD BE TO THE PROPERTY OWNER FOR LABOR, TREE AND
MATERIAL.
3. UNAPPROVED TREE WHICH IS NOT A PROBLEM TO THE CITY OR IS
AN UNDESIRABLE SPECIES. ("B" PRIORITY)
CITY WILL REMOVE AND REPLACEMENT WILL BE AT THE PROPERTY
OWNER'S EXPENSE, SUBJECT TO OTHER CITY PRIORITIES.

Dear Mr. West:
I am a resident of Tustin and reside at 14751
Birchwood Place.
There is a tree located on City property in front
of my house which is a nuisance; it serves as a roost for
several hundred birds in the morning and the evening. The
tree has caused the City to replace 15 feet of sidewalk and
a portion of my driveway in the past. Unless it is removed
in the near future, it will cause further damage to the
sidewalk and driveway. I request that the City remove
the tree. I will then replace the tree with appropriate
landscaping.
