The Resolution also repeats all conditions of Planning Agengy Resolution No. 2062. It is recommended that Resolution No. 82-88 be adopted as drafted. JSO:jh 11-10-82 1 2 3 4 § 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 82-88 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN UPHOLDING PLANNING AGENCY APPROVAL OF USE PERMIT 82-22 WITH CONDITIONS The Ctty Council of the City of Tusttn does hereby resolve as follows: I. The City Council finds and determines as follows: A. That a proper application (Use Permit No. 82-22), was filed on behalf Goldwyn Enterprises by Arthur Johnson to authorize 45 seats for sit down eating and wine tasting at 151N. Tustin Ave. B. That a public hearing was duly called, noticed and held on said application on October 4, 1982. C. That the Planning Agency, by Resolution No. 2062, approved Use Permit 82-22. D. That an appeal was filed, duly noticed and a hearing conducted by the City Council on November 1, 1982. E. That evidence was presented to the Council showing the establishment, maintenance, and operation of the use applied for at the site will be compatible with existing uses if the maximum number of seats is limited to 36 in lieu of the previously approved 45 seats. II. The City Council hereby upholds the decision of the Planning Agency and approves the use of 36 seats for eating and wine tasting at 151 N. Tustin Ave. subject to the following conditions: Ae That the applicant shall provide, at his own expense, parking signs identifying parking spaces for 131 N. Tustin Ave for office visitors only. That a one-year review period be imposed; and that if after one year it is determined by the Planning Agency that a parking problem has developed, all necessary modifications to the site to ~esolve the problem shall be required. That a reciprocal parking agreement (or similar guarantee) with 171N. In the future, if the use at ].7! N. Tustin Avenue is changed to a more intense use, the Heritage House will have to modify their seating capacity accordingly. E. Construction drawings shall be submitted by a licensed architect which show the change of occupancy as required by the Uniform Building Code.
