Because of the size of the lot, the City authorized the purchase of 26 parking spaces from the parking district. All of the required parking for this building is provided in the parking district. Currently, about 2,013 square feet are being used for office purposes with the remaining three suites (3,387 square feet) being vacant. OISCUSSION WPEC Transcendental Medition is requesting authorization to operate a three-person office during regular working hours at the subject site pursuant to Ordinance No. 882 which the City Council adopted in November, 1982. In addition, the organization is requesting authorization to conduct meditation classes and counseling services in the offices. Maximum attendance expected in the evening is 50. The parking demand, based upon a code requirement of one space for each three participants, is 17 spaces. The applicant has an agreement for 35 spaces for night use from the adjacent property owner. This building currently has no night users. The applicant therefore has access to 35 spaces at night, plus has an allocation of 16 additional spaces purchased from the parking district for the three vacant units. The applicant entered into this project just after the passage of Ordinance No. 882 regarding the City Council concern of office uses in the Commercial districts. Vacant units 2,3, and 4 do not have street exposure and therefore are not desireable locations for retail users. 2. The use of 35 adjacent parking spaces should be more than sufficient to accommodate the anticipated demand for night meetings. The daytime parking demand is allocated in the 26 purchased spaces. 3. While the income to the City will be less than in the activities previously located in the structure, the nightly class activities will bring people into the downtown area who may visit retail businesses and make purchases (i.e., dining). If the members believe the use of this retail area for class activity will not have a significant negative fiscal impact, a draft resolution of approval is attached for the Agency's consideration. AGW:jh 12-14-82 TM® Transcendental ,Meditation Program 178;½~ Sky Park Circle, Suitc A h'x'inc, C,\ (712t-) 957-6008 November 29, 1982 We (Carl and Cindi Priebe) representing World Plan Executive Council (WPEC) which is the parent national organization supervising the Transcendental Meditation Program in the U.S. hereby apply for a conditional use permit to permit the operation of the T.M. Program in the office space located at 220 E1 Camino Real, units #2, #3, and #4 (also called #5) in Tustin, California. The Transcendental Meditation Program is a nationally recognized non-profit educational organization, tax exempt on the federal level, which has the singular purpose of personal instruction in a simple mental technique for self improvement. T~e instruction follow up classes range in a size of one person to 10 or 15 people, with advanced follow up meetings on Friday nights which range in size from one person to 20 people. There is also an advanced follow up meeting each evening at approximately 6:00 P.M. that ranges in size from one person to 50 people, with an average of ~5 people. Unit 2 would be the location of the ladies' meeting with between 10 and 20 ladies attending, and unit 4 would be the location of the men's meeting, with between 20 and 30 men attending. Unit 8 is the location of the initial personal instruction and small group follow up meetings (between one and fifteen people). Reception and administrative work to accompany the personal instruction would also be performed in unit 3, with a staff of Carl and Cindi Priebe and a secretary. Our activity, since it has to do with a mental technique, is performed quietly~ with the office administration typical .small office activity. Ail of the large meetings will be held after 5:00 P.M. generally between 6:00 and 9:00 P.M. at a time when there is an abundance of available parking in the adjacent parking lot which is designated to be shared by the tennants of the location at 220 E1 Camino Real. The only daytime parking requirement would be for Carl and/or Cindi Priebe, and the recep- tionist. The accompanying plot plan will illustrate that there is adequate parking for our proposed activities. It is our ernest hope that you permit us to operate under these conditions. 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 2071 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, AUTHORIZING THE USE OF UNITS 2, 3, & 4 OF 220 EL CAMINO REAL FOR GENERAL OFFICE AND NIGHT-TIME INSTRUCTIONAL CLASS ACTIVITIES The Planning Agency of the City of Tustin does hereby resolve as follows: I. The Planning Agency finds and determines as follows: A. That a proper application, (Use Permit 82-33), has been filed on behalf of World Plan Executive Council (WPEC) Transcendental Meditation Program to operate 'a professional office use with night instructional classes at 220 E1Camino Real. B. That a public hearing was duly called, noticed and held on said application. C. That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The proposed use is in conformance with the C-2 District provisions of the City Zoning Code. D. That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject project, nor to the general welfare of the city of Tustin, and should be granted. E. Proposed development shall be in accordance with the development policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. F. This project is categorically exert from the requirements of the California Environmental Quality Act. G. The Planning Agency hereby approves Conditional Use Permit No. 82-33, to authorize the operation of a general office and night-time class facility as applied for subject to the following conditions: A. The applicant shall acquire permission to use 35 parking spaces between the hours of 6:00 p.m. and 9:00 p.m. for a three-year period on the adjoining parking lot from the property owner, Sunset Properties. B. That the use permit must be re-evaluated by the Planning Agency after three years to assure adequate parking accommodations for the use. C. The application shall submit plans of the existing floor plan of the whole building and the subject three units with the proposed alterations for review in compliance with the requirements of the prevailing technical codes, City ordinances, State code and regulations, etc., of the proposed new occupancy or use. D. Any meeting room exceeding 750 square feet must satisfy special State Fire Marshall requirements. E. That the class activities will be limited to 50 participants and between the hours of 6:00 p.m. and 9:00 p.m. PASSED AND ADOPTED at a regular meeting of the Tustin Planning Agency held on the day of , 1982.
