SUBJECT: ALLEY VACATION AND ABANDONMENT
RECOMMENDATION:
That the Tustin Planning Agency, at their meeting of December 20, 1982, find that
this alley abandonment be a categorical exemption from the California
Environmental Quality Act (CEQA) requirement and that the Agency pass and adopt
the attached resolution recommending the City Council disposition of a portion of
the alley right-of-way between E1 Camino Real and "C" Street.
BACKGROUND:
On December 20, 1982, the City'Council will be considering adoption of a
resolution declaring the City's intent to vacate and abandon a portion of the
alley between E1Camino Real and "C" Street and northerly of Second Street.
That portion of alley to be vacated and abandoned is designated and delineated on
Exhibit "A".
The request for this alley abandonment comes from two individuals as indicated on
the attached letter, so that the proposed office building development for 175 "C"
Street can proceed as outlined in Variance No. 82-9. This alley presently
contains a sanitary sewer facility which also will require abandonment. The
property owner at 175 "C" St. has mede provisions to provide sewer connection for
the parcel at 170 E1Camino Real.
Records indicate there are no other utility easements located within the alley.
It is requested that this abandonment be found as a categorical exemption under
the California Environmental Quality Act (CEQA).

A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF
TUSTIN RECOMMENDING TO THE CITY COUNCIL DISPOSITION OF
A PORTION OF ALLEY RIGHT-OF-WAY BETWEEN EL CAMINO REAL
AND "C" STREET AND NORTHERLY OF SECOND STREET
The Planning Agency of the City of Tustin does hereby resolve as
1. The Planning Agency finds and determines as follows:

That a proper application was filed by the property owners
to the Planning Agency for the purpose of determining the
needs, if any, of public right-of-way known as a portion of
an alley between E1Camino Real and "C" Street and
northerly of Second Street as described by Exhibit "A"
attached hereto and incorported herein by this reference as
set forth herein in full.

That the subject property should be declared excess to the
City's needs and disposed of for private development for
the following reasons:
The alignment and configuration of the alley has been
established with the approved site plan for the
development at 175 "C" Street and 170 E1 Camino Real.
(2) The property is not suitable nor adequate for other
public purposes, such as parks or recreational needs.
(3) There is no known use of the property as alley
right-of-way.
That pursuant to Section 8330 of the Streets and Highways
Code for the State of California, it is possible to reserve
public interest in easements for sewers, storm drains, and
utility purposes.
That the Agency recommends the vacation of the easement for
alley purposes to the adjoining property owners without
fee.
e. Subject project is categorically exempt from the California
Environmental Quality Act.
f. That the vacation of the subject alley right-of-way will be
in conformance with the City of Tustin General Plan.

The Planning Agency, pursuant to Sections 37350 and 65402 of
the Government Code, hereby recommends to the City Council the
declaration of the subject parcel as excess to the needs of the
City and it~ disposition to the adjoining property owners with
the reservation of easements to conduct, maintain, operate,
replace, remove, and renew those facilities necessary for storm
drains, sewers, and public utilities.
.PASSED AND ADOPTED at a regular meeting of the Planning Agency of
the City of Tustin, California, held on the 20th day of December , 1982.

Vacation and abandonment of a portion of an alley between E1
Camino Real and "C" Street and northerly of Secton Street.
Those portions of Lots 3 and 18, Book 4, of the Tustin City tract
as shown on a map recorded in Book 4, Page 218, Miscellaneous
Records of Los Angeles County, California, described as follows:
The westerly 10.00 feet of Lot 3, Block 4, of said Tustin City
Tract and the easterly 10.00 feet of Lot 18, Block 4, of said
Tustin City tract.
